No. 6 of 1947.

An Act to approve the Ratification on behalf of Australia of the Convention on International Civil Aviation concluded at Chicago on the seventh day of December, One thousand nine hundred and forty-four, and for other purposes.

Preamble. WH E R E A S a Convention on Internat ional Civil Av ia t ion was concluded a t Chicago on the seventh d a y of December.

A N D W H E R E A S Austra l i a is a p a r t y to the sa id Convention:

A N D W H E R E A S it is desirable t h a t the ratif ication on behalf of

Austra l ia of the sa id Convention be a p p r o v e d b y the Par l iament and necessary provis ion m a d e for carrying out and giving effect to the sa id Convention:

B E i t therefore enacted b y the K i n g ' s Most Exce l lent Majesty

the Sena te, and the House of Repre senta t ive s of the Commonwealth

of Aus t ra l i a, a s follows :—

Short title and eltation. 1 .—(1. ) This A c t m a y be cited a s the Air Navigation Act 1947.

(2.) T h e Air Navigation Act 1920-1936 * is in this Act referred to

as the Principal Act.

(3.) The Principal Act, a s amended b y this Act, m a y be cited as the Air Navigation Act 1920-1947.

???. 2. Sect ion three of the Principal A c t is amended b y omit t ing the

definitions of " T e r r i t o r i e s " and " t h e C o n v e n t i o n " and inserting

in their s t e a d the following definitions :—

" ' T e r r i t o r y ' includes a Terr i tory adminis tered a s a trust

territory b y Austra l i a in pursuance of Chapter X I I. of t h e

Charter of the United Nations;

"'the Chicago Convention' means the Convention on Inter

nat ional Civil Avia t ion concluded a t Chicago on the seventh d a y of December, One t h o u s a n d nine hundred and forty four; ".

3. After section three of the Pr incipal A c t the following section is inserted :—

4. Sect ion four of the Pr incipal A c t is a m e n d e d — Power to give effect

(a) by omitting the word "Convention" (first occurring) and to Paris

inserting in its stead the words "Paris Convention (being Convention

the Convention for the Regu la t ion of Aerial Nav iga t ion signed in Par i s on the thirteenth d a y of October, One

thousand nine hundred and n i n e t e e n ) "; a n d

(b) by inserting before the word "Convention" (second occurring)

the word "Paris".

5. After sect ion four of the Pr incipal A c t the following section is

inserted :—

" 5.	T h e Governor-General m a y m a k e regulat ions for the purpose	Power to
give effect

of carrying ou t and giving effect to the Chicago Convention a n d the	to Chicago
provisions of any a m e n d m e n t of the Chicago Convention m a d e under	Convention
Article ninety-four thereof and for the purpose of providing for the control of air nav iga t ion—

(a) in relation to trade and commerce with other countries and

among the States;

(b) in relation to the Naval and Military defence of the Common-

wealth and of the several States;

(c) in relat ion to pos ta l a n d other like services;

(d) within any Terr i tory of the Commonweal th;

(e) within any State the Parliament of which has referred to the

Parliament of the Commonwealth the matter of the control

of air navigation within that State; and

(f) for carrying out and giving effect to any other international

convention or agreement relat ing to air nav iga t ion to

which Austra l i a is or becomes a p a r t y ".

6. Sect ion four of the Principal A c t a s amended b y this A c t shall cease to have effect a s a t midnight on the ninth d a y of A u g u s t, One thousand nine hundred and forty-seven and shall be deemed to be ???

repealed a s a t t h a t t ime.
