REGULATIONS UNDER THE AIR FORCE ACT 1923-1956.*

I, THE ADMINISTRATOR of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923-1956.

Amendments of the Air Force Regulations. 

1. Regulation 543 of the Air Force Regulations is repealed and the following regulation inserted in its stead:—

Active pay of officers.

“543.—(1.) Subject to sub-regulations (2.), (3.), (4.), (5.) and (6.) of this regulation, the daily rate of active pay of an officer of the Permanent Air Force, other than an officer of a rank higher than group captain, an officer of the chaplains' branch or an officer of the Women's Service holding a rank specified in sub-regulation (9.) or (10.) of this regulation, is the rate specified, in relation to his rank and service, in the following table:—

“(2.) The daily rate of active pay of an officer of the rank of flight lieutenant shall not exceed the rate specified in the table in sub-regulation (1.) of this regulation in relation to an officer of that rank who has completed four years’ service in that rank unless the officer has passed such examinations for promotion to the rank of squadron leader as the Air Board determines.

“(3.) The daily rate of active pay of an officer who—

(a)was granted a commission in the Permanent Air Force after the thirty-first day of December, 1955, or is granted such a commission, with the rank of pilot officer;

(b)was or is, at the date of his appointment, enrolled as a student of science, engineering, medicine, dentistry or education at a University or Technical College; and

(c) is not a graduate of the Air Force Academy,

is the rate specified, in relation to his course of study and stage reached in the course, in the following table:—

“(4.) The daily rate of active pay of an officer who—

(a) holds a degree in medicine or surgery of a University approved by the Director-General of Medical Services; and

(b)is appointed as a resident medical officer in a Royal Australian Air Force hospital or in another hospital approved by the Director-General of Medical Services,

in respect of the period from and including the date determined by the Air Board as the date of appointment of the officer as resident medical officer to and including the date as from which his appointment as resident medical officer is terminated, is Five pounds three shillings and ninepence.

 

“(5.) Subject to the next succeeding sub-regulation, where an amount equal to the daily rate of active pay of an officer of the Permanent Air Force who has been commissioned from warrant or non-commissioned rank when aggregated with any flying pay payable to him under regulation 553a would, but for this sub-regulation, be less than the daily rate of active pay, excluding any increase given by virtue of sub-regulation (3.) of regulation 550, from time to time payable to a member holding the like rank and mustering, and having completed the like service in that rank and mustering, as the officer held and had completed immediately before his appointment to commissioned rank—

(a)if the officer holds the rank of flying officer—the daily rate of active pay of the officer is the rate applicable to a flying officer having two years’ service in that rank; or

(b) in any other case—the daily rate of active pay of the officer is that rate of active pay payable to such a member excluding any increase given by virtue of sub-regulation (3.) of regulation 550.

“(6.) Where the daily rate of active pay of an officer of the Permanent Air Force who has been commissioned in a branch other than the general duties branch from warrant or non-commissioned rank in an air crew mustering would, but for this sub-regulation, be less than the daily rate of active pay from time to time payable to a member of a ground mustering in Group 6 holding the like rank, and having completed the like service in that rank, as the officer held and had completed immediately before his appointment to commissioned rank, the daily rate of active pay of the officer is that latter rate.

“(7.) Subject to the next succeeding sub-regulation, the daily rate of active pay of an officer of the chaplains' branch of the Permanent Air Force is the rate specified, in relation to his classification and service, in the following table:—

“(8.) The daily rate of active pay of an officer of the chaplains' branch of the Permanent Air Force who is serving as a Chaplain, Third Class, and has so served continuously since the fourteenth day of August, 1955, is Five pounds nineteen shillings and tenpence.

2.—(1.) Regulation 544 of the Air Force Regulations is repealed and the following regulation inserted in its stead:—

Consolidated rates of pay.

“544.—(1.) The rate of pay of the Chief of the Air Staff is a consolidated rate of pay of Six thousand one hundred and fifty pounds per year.

“(2.) The rate of pay of an air marshal appointed as Chairman, Chiefs of Staff Committee, is a consolidated rate of pay of Six thousand four hundred pounds per year.

“(3.) The rate of pay of an air vice-marshal of the Permanent Air Force is a consolidated rate of pay of Five thousand six hundred and twenty-five pounds per year.

“(4.) The rate of pay of an air commodore of the Permanent Air Force is a consolidated rate of pay of Four thousand seven hundred and eighty-five pounds per year.".

(2.) Regulation 544 of the Air Force Regulations, as amended by these Regulations, applies to and in relation to service of an air vice-marshal of the Permanent Air Force on and after the twenty-fifth day of June, 1964.

(3.) The rate of active pay of an air commodore, in respect of service on a day in the period from and including the twenty-fifth day of June, 1964, to and including the day immediately before the commencement of these Regulations, is increased by an amount equal to the amount by which the sum of—

(a)the active pay payable to him in respect of that day under the Air Force Regulations as in force immediately before the commencement of these Regulations; and

(b)the allowances (being allowances not payable to an officer in receipt of pay at a consolidated rate of pay) payable to him in respect of that day under the Air Force Regulations as amended by these Regulations in their application in relation to service on that day,

is less than Thirteen pounds two shillings and twopence.

Pay of air cadets.

3.—(1.) Regulation 548 of the Air Force Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(2.) Regulation 548 of the Air Force Regulations is amended—

(a)by omitting from the first column of the table in sub-regulation (1b.) the words “Junior equipment and administrative trainees” and all words in the second column of that table in relation to those words; and

(b)by omitting from the first column of that table the words “Airmen other than airmen in an aircrew mustering, airmen apprentices and junior equipment and administrative trainees” and inserting in their stead the words “Airmen other than airmen in an aircrew mustering and airmen apprentices”.

 

Pay of airmen other than air crew, cadets, and apprentices.

4.—(1.) Regulation 549 of the Air Force Regulations is amended by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) The daily rate of active pay of an airman of the Permanent Air Force, other than an air cadet, an airman in an aircrew mustering, an airman apprentice or an airwoman is the rate specified, in relation to his rank, classification, group and service, in the following table:—

7. Regulation 551a of the Air Force Regulations is repealed and the following regulation inserted in its stead:—

Special increase in active pay.

“551a. The rate of active pay payable to a member in accordance with sub-regulation (1.) of regulation 549 or sub-regulation (1.) of regulation 550 is, by virtue of this regulation, increased by Four shillings per day.”.

 

Marriage allowance.

8. Regulation 555 of the Air Force Regulations is amended—

(a)by omitting from sub-regulation (2.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”;

(b)by omitting from paragraphs (b)and (d)of sub-regulation (3.) the words “Fourteen shillings” and inserting in their stead the words “Fifteen shillings”;

(c) by omitting from paragraph (e)of sub-regulation (3.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”;

(d)by omitting from paragraphs (b)and (d)of sub-regulation (5.) the words “Fourteen shillings” and inserting in their stead the words “Fifteen shillings”; and

(e) by omitting from paragraph (e)of sub-regulation (5.) the words “Eight shillings and threepence” and inserting in their stead the words “Nine shillings and sixpence”.

Conditions to be complied with before marriage allowance is payable.

9. Regulation 555a of the Air Force Regulations is amended by omitting from paragraph (a)of sub-regulation (2.) the words “One pound nine shillings and threepence” and inserting in their stead the words “One pound eleven shillings and sixpence”.

10. Regulation 556c of the Air Force Regulations is repealed and the following regulation inserted in its stead:—

Allowance for medical and dental officers.

“556c.—(1.) Subject to this regulation, an officer of the medical branch of the Permanent Air Force who is a qualified medical or dental practitioner, and an officer of the Women’s Royal Australian Air Force Branch who is such a practitioner, may be paid an allowance at the rate specified, in relation to the officer's rank and service, in the following table:—

“(2.) Rates of higher duty allowance.

11. Regulation 556k of the Air Force Regulations is amended—

(a)by omitting from sub-paragraph (ii) of paragraph (a) of sub-regulation (2.) the words “air commodore or”; and

(b) by omitting from paragraph (b) of sub-paragraph (2.) the words “air vice-marshal” and inserting in their stead the words “air commodore”.

Hard-lying allowance.

12.—(1.) Regulation 556l of the Air Force Regulations is amended by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

“(3.) The rate at which hard-lying allowance is payable is Three shillings and threepence per day or One shilling and ninepence per day as the Air Board determines.”.

(2.) The first determination made by the Air Board for the purposes of sub-regulation (3.) of regulation 556l of the Air Force Regulations as amended by these Regulations takes effect as if it had been made on the twenty-fifth day of June, 1964.

Supplementary ration allowance.

13.—(1.) Regulation 565a of the Air Force Regulations is amended by omitting from sub-regulation (1.) the words “Fourpence halfpenny” and inserting in their stead the figures and word “5.25 pence”.

(2.) The amendment effected by the last preceding sub-regulation applies in relation to supplementary ration allowance for the first day of July, 1964, and all subsequent days.

Living-out allowance—single members.

14. Regulation 567 of the Air Force Regulations is amended—

(a)by omitting from paragraph (a) of sub-regulation (1.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”; and

(b) by omitting from paragraph (b) of sub-regulation (1.) the words “Fifteen shillings and threepence” and “Nine shillings and ninepence” and inserting in their stead the words “Sixteen shillings and sixpence” and “Ten shillings and threepence”, respectively.

 

Ration allowance.

15. Regulation 569 of the Air Force Regulations is amended—

(a)by omitting from paragraph (d)of sub-regulation (2.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”; and

(b) by omitting from paragraph (e) of sub-regulation (2.) the words “Fifteen shillings and threepence” and “Nine shillings and ninepence” and inserting in their stead the words “Sixteen shillings and sixpence” and “Ten shillings and threepence”, respectively.

Retention of lodgings allowance.

16. Regulation 571a of the Air Force Regulations is amended by omitting from sub-regulation (2.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”.

Uniform allowance.

17. Regulation 573 of the Air Force Regulations is amended—

(a) by omitting the words “Two shillings and sixpence” and inserting in their stead the words “Two shillings and ninepence”; and

(b)by omitting the words “a junior equipment and administrative trainee under seventeen years of age or”.

Free replacement of uniforms for airmen apprentices.

18. Regulation 573a of the Air Force Regulations is amended by omitting the words “A junior equipment and administrative trainee of the Permanent Air Force under seventeen years of age or an” and inserting in their stead the word “An”.

Rates of travelling allowance.

19. Regulation 578 of the Air Force Regulations is amended by omitting from paragraph (b)of sub-regulation (3.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”.

Reduction of rate when subsistence or quarters is provided.

20. Regulation 590 of the Air Force Regulations is amended by omitting from sub-regulation (4.) the words “Nine shillings and ninepence” and inserting in their stead the words “Ten shillings and threepence”.

Allowances and other benefits.

21.—(1.) Regulation 647 of the Air Force Regulations is amended by omitting paragraphs (g) and (h)of sub-regulation (2.) and inserting in their stead the following word and paragraph:—

“and (g) allowance for use of own conveyance.”.

(2.) Regulation 647 of the Air Force Regulations is amended by inserting after sub-regulation (3.) the following sub-regulation:—

“(3a.) An officer of the medical branch of the Citizen Air Force who is a qualified medical or dental practitioner may be paid an allowance at the rule specified, in relation, to his rank, in the following table:—

Application.

22.—(1.) Subject to the next succeeding sub-regulation, the amendments of the Air Force Regulations effected by regulations 1, 3, 4, 5, 6, 7, 8 and 9, sub-regulation (1.) of regulation 12 and regulations 14, 15, 16 and 17 of these Regulations apply in relation to service in the Permanent Air Force on and after the twenty-fifth day of June, 1964, and in relation to service in the Citizen Air Force on and after the first day of July, 1964.

(2.) The amendments of the Air Force Regulations effected by regulation 1 of these Regulations do not not apply in relation to service, before the commencement of this regulation, of an officer who was in receipt of, or entitled to receive, the allowance provided for in regulation 556c of the Air Force Regulations.

(3.) The rate of active pay that would, but for this sub-regulation, be the rate of active pay for an officer (being an officer in receipt of, or entitled to receive, the allowance provided for in regulation 556c of the Air Force Regulations as in force immediately before the commencement of these Regulations)—

(a)in respect of service in the Permanent Air Force on a day in the period from and including the twenty-fifth day of June, 1964, to and including the day immediately before the commencement of this regulation; or

(b)in respect of service in the Citizen Air Force on a day in the period from and including the first day of July, 1964, to and including the day immediately before the commencement of this regulation,

is increased by the amount by which the sum of the active pay of the officer in respect of that day under the Air Force Regulations as in force on that day and the allowance payable in respect of that day by virtue of regulation 556c of the Air Force Regulations as so in force is less than the sum of active pay and allowance under regulation 556c or sub-regulation (3a.) of regulation 647, as the case requires, of the Air Force Regulations would have been if the amendments effected by these Regulations had been in force on that day.

(4.) Where, but for this sub-regulation, a member would, by virtue of the application of the amendments of sub-regulation (3.) or (5.) of regulation 555 of the Air Force Regulations as from the twenty-fifth day of June, 1964, in accordance with sub-regulation (1.) of this regulation, cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance, or the rate of marriage allowance shall not be reduced, as the case may be, until the date of commencement of these Regulations.

(5.) Where an allotment made by a member was in force in respect of the period from and including the twenty-fifth day of June, 1964, to and including the day immediately preceding the commencement of these Regulations, or in respect of any part of that period, at a rate that entitled him to marriage allowance at the rate of Eight shillings and threepence per day but would not entitle him to marriage allowance at the rate of Nine shillings and sixpence per day under the Air Force Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or part of the period, as the case may be, and, if he does so, marriage allowance is payable in accordance with the Air Force Regulations as amended by these Regulations as if the increased allotment had been in force during the period or part of the period.
