REGULATIONS UNDER THE AIR FORCE ACT 1923-1965.*

advice of the Federal Executive Council, hereby make the following Regulations
under the

Amendments of the Air Force Regulations
" 51.—(1.) For the purpose of precedence, a chaplain who holds an appointment of Principal Air Chaplain shall be deemed to hold a rank that corresponds with the rank of Air Commodore.
" (2.) For the purpose of precedence, a chaplain, other than a chaplain who holds an appointment of Principal Air Chaplain, shall be deemed to hold a rank that corresponds with the rank specified in the second column of the following table in relation to his length of service in the rank of chaplain:—

" (1.) The age for the compulsory retirement of an officer, other than an officer who is a chaplain of the Air Force or a member of the Nursing Service, is the age set out in the following table in relation to the substantive rank that the officer holds and the branch in which he is serving:—

(2.) Regulation 88 of the Air Force Regulations is amended by inserting after sub-regulation (1a.) the following regulation:—
" (1b.) The age for the compulsory retirement of a chaplain of the Air Force, other than a chaplain who holds an appointment of Principal Air Chaplain, is—
(
a ) in the case of a chaplain whose length of service in the rank of chaplain will exceed eighteen years upon his attaining the age of fifty-five years—fifty-seven years; or(
b ) in any other case—fifty-five years.".
6.—(1.) Regulation 97 of the Air Force Regulations is amended by omitting the table in sub-regulation (5.) and inserting in its stead the following table:—

(2.) Sub-regulation (5.) of regulation 97 of the Air Force Regulations as in force immediately before the commencement of these Regulations continues, notwithstanding the last preceding sub-regulation, to apply to and in relation to an air cadet who enlisted in the Permanent Air Force as an air cadet on or after, the thirtieth day of January, 1964, and before the commencement of these Regulations.
" (8.) Subject to sub-regulation (8c.) of this regulation, the daily rate of active pay of an officer of the chaplains' branch of the Permanent Air Force, not being an officer who holds the appointment of Principal Air Chaplain, is the rate specified in relation to his length of service in the rank of chaplain in the following table;—

(2.) Regulation 543 of the Air Force Regulations is amended by inserting after sub-regulation (8.) the following sub-regulation:—
" (8a.) The daily rate of active pay of an officer of the chaplains' branch of the Permanent Air Force who holds an appointment of Principal Air Chaplain is Nineteen dollars fifty-six cents per day.
" (8b.) For the purpose of sub-regulation (8.) of this regulation, where an officer of the chaplains' branch of the Permanent Air Force was serving in that branch immediately before the date of commencement of this sub-regulation, the service of the officer before that date in any of the following classifications, namely, Chaplain Fourth Class, Chaplain Third Class, Chaplain Second Class, or Chaplain First Class, shall be deemed to be service in the rank of chaplain.
" (8c.) Where the rate at which active pay would be payable to an officer of the chaplains' branch of the Permanent Air Force, being an officer who was serving in that branch immediately before the commencement of this sub-regulation, if the amendments of the Air Force Regulations effected by the Statutory Rule by which this sub-regulation was inserted in the Air Force Regulations had not been made is higher than the rate at which active pay would, but for this sub-regulation, be payable to the officer under these Regulations, the daily rate of active pay applicable in the case of the officer is, by force of this sub-regulation, that higher rate.".
(
a ) by omitting from the table in sub-regulation (1.) the words " and Chaplain, First Class ", " Chaplain, Second Class,", " and Chaplain, Third Class " and " Chaplain, Fourth Class,"; and(
b ) by adding at the end thereof the following sub-regulation:—" (4.) This regulation applies to and in relation to an officer who is a chaplain of the Air Force as if the officer held the rank that corresponds with the rank that he is to be deemed to hold for the purpose of precedence.".
(
a ) by omitting from the table in sub-regulation (1.) the words " and Chaplain, First Class ", " Chaplain, Second Class,", " and Chaplain, Third Class " and " Chaplain, Fourth Class,"; and(
b ) by adding at the end thereof the following sub-regulation:—" (3.) This regulation applies to and in relation to an officer who is a chaplain of the Air Force as if the officer held the rank that corresponds with the rank that he is to be deemed to hold for the purpose of precedence.".
" 575a. A member of the Permanent Air Force who is aide-de-camp to the Governor-General or to the Governor of a State—
(
a ) may be provided by the Commonwealth, without charge to the member, with such additional personal clothing and necessaries as the Air Board approves; and(
b ) may be reimbursed by the Air Board the cost to the member of any additional articles of personal clothing or necessaries, being articles of clothing or necessaries included in a class of articles of clothing and necessaries approved by the Air Board for the purpose of this paragraph, that the member has purchased for use in connexion with the performance of his duties as an aide-de-camp.".
(
a ) by omitting from the table in sub-regulation (1.) the Words " Principal Air Chaplain,", " Chaplain, First Class,", " Chaplain, Second Class," and " Chaplain, Third Class,"; and(
b ) by adding at the end thereof the following sub-regulation:—" (5.) This regulation applies to and in relation to an officer who is a chaplain of the Air Force as if the officer held the rank that corresponds with the rank that he is to be deemed to hold for the purpose of precedence.".
(
a ) by omitting from the table in sub-regulation (8.) the words " Principal Air Chaplain,", " Chaplain, First Class,", " Chaplain, Second Class," and " Chaplain, Third Class,"; and(
b ) by adding at the end thereof the following sub-regulation:—" (10.) This regulation applies to and in relation to an officer who is a chaplain of the Air Force as if the officer held the rank that corresponds with the rank that he is to be deemed to hold for the purpose of precedence.".
" 633a.—(1.) A member of the Permanent Air Force who is serving or has served in the New Guinea Area may be paid such allowances appropriate to the locality in which and the conditions under which he is or was serving at such rates and subject to such conditions as the Air Board determines.
" (2.) In the last preceding sub-regulation, ' the
New Guinea Area ' means the Territory of New Guinea as described in the Second
Schedule to the
(
a ) by omitting from paragraph (a ) of sub-regulation (3.) the words " Eight hundred and sixty dollars " and inserting in their stead the words " One thousand and fifty-five dollars "; and(
b ) by omitting from paragraphs (b ) and (c ) of sub-regulation (3.) the words " One hundred and forty-six dollars and sixty-seven cents " and inserting in their stead the words " One hundred and sixty-eight dollars thirty-three cents ".
(2.) Where a member was in receipt of educational allowance in respect of the attendance of a child at a school as a boarder during the period from and including the first day of January, 1966 to and including the thirty-first day of December, 1966, or during a part of that period—
(
a ) the Air Board shall determine the amount that it would have considered reasonable for the purposes of paragraph (a ) of sub-regulation (3.) of regulation 634 of the Air Force Regulations if the amount specified in that paragraph had been Nine hundred and seventy-five dollars; and(
b ) the member is, by virtue of this regulation, entitled to be paid a sum equal to the amount by which the amount so determined is greater than the amount of education allowance paid in respect of the attendance of the child at a school as a boarder during that period or that part of that period.
(3.) Education allowance is payable in accordance with regulation 634 of the Air Force Regulations in respect of the attendance of a child at a school on or after the first day of January, 1967, as if the amendments of that regulation effected by regulation 5 of these Regulations had come into operation on the first day of January, 1967.
" (2a.) A member of the Citizen Air Force who is appointed aide-de-camp to the Governor-General or to the Governor of a State—
(
a ) may be provided with a free issue of such additional items of personal clothing and necessaries as are approved by the Air Board; or(
b ) may be reimbursed by the Air Board the cost to the member of any additional articles of personal clothing or necessaries, being articles of clothing or necessaries included in a class of articles of clothing and necessaries approved by the Air Board for the purpose of this paragraph, that the member has purchased for use in connexion with the performance of his duties as an aide-de-camp."
(2.) Where—
(
a ) a member of the chaplains' branch of the Permanent Air Force was paid or is entitled to be paid active pay in respect of the relevant period or a part of the relevant period; and(
b ) the amount of active pay paid or payable to the officer in respect of the relevant period or the part of the relevant period is less than the amount of active pay that would have been or would be payable to the officer in respect of the relevant period or the part of the relevant period if the amendments of the Air Force Regulations effected by these Regulations had come into force on the seventeenth day of July, 1967,
the officer is, by virtue of this sub-regulation, entitled to be paid an amount equal to the difference.
