REGULATIONS UNDER THE AIR FORCE ACT 1923-1965.*

I THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923-1965.

Amendments of the Air Force Regulations

Active pay of officers.

1. Regulation 543 of the Air Force Regulations is amended by omitting sub-regulations (5.) and (6.) and inserting in their stead the following sub-regulations:—

" (5.) The next succeeding sub-regulation applies to and in relation to an officer of the Permanent Air Force who has been commissioned from warrant or non-commissioned rank if—

(a) in a case where the officer is entitled to flying pay—the sum of the daily rate of active pay of the officer and the daily rate at which flying pay is payable to him (excluding any increase in flying pay given by virtue of regulation 554) ; or

(b)in a case of any other officer—the daily rate of active pay of the officer,

would, but for the next succeeding sub-regulation, be less than—

(c) if he were appointed to commissioned rank on or after the first day of March, One thousand nine hundred and sixty-eight—the daily rate of active pay (excluding any increase in that rate given by virtue of sub-regulation (3.) of regulation 550) applicable to him on the day immediately preceding the date of his appointment to commissioned rank; or

(d)in any other case—the daily rate of active pay (excluding any increase in that rate given by virtue of sub-regulation (3.) of regulation 550) that was on the twenty-ninth day of February, One thousand nine hundred and sixty-eight, applicable to a member holding the like rank and mustering, and having completed the like service in that rank, as the officer held and had completed immediately before his appointment to commissioned rank.

" (6.) The daily rate of active pay of an officer to whom this sub-regulation applies is, notwithstanding any other provision of these Regulations—

(a) in the case of an officer who holds the rank of Flying Officer and had been appointed to a commission with that rank before the commencement of these Regulations—the rate ascertained in accordance with the next succeeding paragraph or a rate of Nine dollars and seventy-two cents per day, whichever is the higher rate; or

(b)in any other case—a rate ascertained by subtracting from the rate referred to in paragraph (c) or (d)of the last preceding sub-regulation, whichever is applicable in the case of the officer, the rate at which flying pay, if payable, is payable to him (excluding any increase in flying pay given by virtue of regulation 554),".

Pay of airmen other than cadets and apprentices.

2. Regulation 549 of the Air Force Regulations is amended—

(a) by omitting sub-regulations (1.) and (2.) and inserting in their stead the following sub-regulations:—

" (1.) Subject to sub-regulation (4.) of this regulation, the daily rate of active pay of an airman of the Permanent Air Force (other than an air cadet, an airman apprentice or an airwoman) holding a rank other than Aircraftman (Recruit) or trainee aircrew is the rate specified in Part I., Part II., Part III., or Part IV., whichever is appropriate, of the Fifth Schedule to these Regulations in relation to his rank, the group in which his mustering is classified and, if relevant, his length of service in his rank.

" (1a.) The daily rate of active pay of an airman of the Permanent Air Force holding the rank of Aircraftman (Recruit) is the daily rate of active pay specified in Part I. of the Fifth Schedule to these Regulations in relation to an airman holding the rank of Aircraftman and included in Group 1.

" (2.) Subject to sub-regulation (4.) of this regulation, the daily rate of active pay of an airwoman of the Permanent Air Force holding a rank other than Aircraftwoman (Recruit) is the rate specified in Part I., Part II., Part III., or Part IV., whichever is appropriate, of the Sixth Schedule to these Regulations in relation to her rank, the group in which her mustering is classified and, if relevant, her length of service in her rank.";

(b) by omitting from sub-regulation (2a.) the words " the table in the last preceding sub-regulation " and inserting in their stead the words " Part I. of the Sixth Schedule to these Regulations "; and

(c) by adding at the end thereof the following sub-regulations:—

" (4.) Where—

(a) an airman, other than an air cadet, an airman in an aircrew mustering or an airman apprentice, was serving in the Permanent Air Force on the twenty-eighth day of February, One thousand nine hundred and sixty-eight (hereinafter called ' the specified date') ;

 

(b)the airman held or holds, on a day (hereinafter called ' the relevant day ') after the specified date, the same rank that he held on that date; and

(c) the airman was or is, on the relevant day, serving in—

(i) the same mustering as the mustering in which he was serving on the specified date; or

(ii) a mustering that did not exist on the specified date, not being a mustering to which he had been transferred at his own request,

the daily rate of active pay of the airman in respect of the relevant day is, in a case where the daily rate of active pay that was applicable to the airman on the specified date is higher than the daily rate of active pay that would, but for this sub-regulation, be applicable to the airman under these Regulations, that higher rate.".

Pay of trainee aircrew.

3. Regulation 550 of the Air Force Regulations is amended by omitting sub-regulations (1.) and (3.).

Flying pay.

4. Regulation 553a of the Air Force Regulations is amended—

(a)by inserting after the words " lower rank " the words " or an airman of the Permanent Air Force in an aircrew mustering of the rank of sergeant or of higher rank ";

(b)by omitting the words " and service "; and

(c) by omitting the table and inserting in its stead the following table:—

5. The Fourth Schedule to the Air Force Regulations is amended—

(a) by omitting from the table headed—

" (i) Modifications."

the words and figures opposite the figures " XV./1./1093 " and inserting in their stead the words " Omit the whole paragraph."; and

(b) by omitting from that table the figures " XVI./1./1230 " and the words and figures opposite those figures.

Transitional.

7.—(1.) In this regulation, " the relevant period " means the period from and including the twenty-ninth day of February, One thousand nine hundred and sixty-eight, to and including the day immediately before the commencement of these Regulations.

(2.) Where, if these Regulations had come into force on the twenty-ninth day of February, One thousand nine hundred and sixty-eight, the rate of active pay that would have been applicable, on a day in the relevant period, to an officer to whom sub-regulations (5.) and (6.) of regulation 543 of the Air Force Regulations as amended by these Regulations would have applied exceeds the rate of active pay that was applicable to the officer on that day under the Air Force Regulations as in force on that day, the rate of active pay applicable to the officer on that day is, by virtue of this sub-regulation, that higher rate.

(3.) An airman of the Permanent Air Force who would have been entitled to flying pay in respect of the relevant period or a part of the relevant period if regulation 553a of the Air Force Regulations as amended by these Regulations had been in force on and after the twenty ninth day of February, One thousand nine hundred and sixty-eight, is, by virtue of this regulation, entitled to be paid as flying pay in respect of that period or that part of that period—

(a)in the case of a sergeant— an amount calculated at the rate of Eighty-seven cents per day; or

(b) in any other case—an amount equal to the amount by which the active pay paid to the member (excluding any increase given by virtue of sub-regulation (3.) of regulation 550) was less than the sum of the active pay and flying pay (excluding any increase given by virtue of regulation 554) that would have been paid to the member if the amendments of the Air Force Regulations effected by these Regulations had come into operation on that date and an aircrew mustering had been included in Group 10.

Application.

8.—(1.) In this regulation, " the relevant period " has the same meaning as in the last preceding regulation.

(2.) The Air Board may determine, in respect of a mustering that existed during the relevant period or a part of the relevant period, that the mustering shall be deemed to have been classified, on each day during the relevant period or on each day during a specified part of that period, in a particular group, being a group specified in the Fifth Schedule or the Sixth Schedule to the Air Force Regulations as amended by these Regulations, and the mustering shall then, for the purpose of sub-regulation (4.) of this regulation, be deemed to have been classified accordingly on that day.

(3.) Subject to the last preceding sub-regulation, a mustering that existed on a day in the relevant period shall, for the purpose of the next succeeding sub-regulation, be deemed to have been classified on that day in the group specified in the Fifth Schedule or Sixth Schedule to the Air Force Regulations as amended by these Regulations distinguished by the same number as the number that distinguished the group in which it was classified on that day under the Air Force Regulations as in force on that day.

(4.) Subject to the next succeeding sub-regulation, the rates of active pay provided for in regulation 549 of the Air Force Regulations as amended by these Regulations apply to and in relation to service of a member in the Permanent Air Force, the Air Force Emergency Force and the Citizen Air Force, as the case requires, on a day in the relevant period as if each mustering that was in existence on that day had been classified in the group in which it is to be deemed to have been classified on that day under the preceding sub-regulations of this regulation.

 

 (5.) The last preceding sub-regulation does not apply to or in relation to service of a member on a day in the relevant period if the rate of active pay applicable in the case of the member under regulation 549 or regulation 550 (excluding any increase given by virtue of sub-regulation (3.) of regulation 550) of the Air Force Regulations as in force on that day is higher than the rate that would be applicable, but for this sub-regulation, in the case of the member by virtue of the last preceding sub-regulation.
