REGULATIONS UNDER THE AIR FORCE ACT 1923-1965.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923-1965.

2. Regulation 544 of the Air Force Regulations is amended by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

" (3.) The rate at which active pay is payable to a male officer of the medical branch of the Permanent Air Force who is a qualified medical practitioner or dental practitioner and holds a rank specified in the following table is the consolidated rate specified, in relation to his rank, in that table:—

3.—(1.) Regulation 553a of the Air Force Regulations is amended by omitting the table and inserting in its stead the following table:—

(2.) A member in receipt of flying pay under regulation 553a of the Air Force Regulations in respect of a day in the period from and including the second day of July, 1970, to and including the day immediately before the commencement of these Regulations, being a member who held the rank of Warrant Officer, Flight Sergeant or Sergeant on that day, is, by force of this sub-regulation, entitled to be paid, as additional flying pay in respect of that day, an amount equal to the amount by which the amount of flying pay paid or payable to him in respect of that day is less than the amount of flying pay that would have been payable to him if flying pay had been payable in respect of that day at the rates specified in regulation 553a of the Air Force Regulations as amended by these Regulations.

4.—(1.) Regulation 553B of the Air Force Regulations is repealed and the following regulations are inserted in its stead:—

Flight pay.

" 553B. Where a member of the Permanent Air Force is appointed to a position as a member of the crew of an aircraft, being a position the designation of which is specified in the following table, and the member is not entitled to be paid flying pay in accordance with regulation 553a of these Regulations or active pay in accordance with regulation 550 of these Regulations in respect of the period of the appointment, the member may be paid flight pay in respect of the period of the appointment at the rate per day specified in the following table in relation to the designation of the position to which he is appointed:—

Flight training pay.

" 553c. Where an airman of the Permanent Air Force undergoes training for the purpose of qualifying him for classification in an aircrew mustering with the rank of Sergeant or a higher rank or for appointment to a position as a member of the crew of an aircraft, being a position having a designation specified in the table in regulation 553b of these Regulations, the airman may be paid flight training pay in respect of the period of the training at a rate per day equal to one-half of the rate per day specified in regulation 553a or 553b of these Regulations, as the case may be, in relation to the rank or position for which the training is intended to qualify him.".

   

(2.) A member in receipt of flight pay under regulation 553b of the Air Force Regulations in respect of a day in the period from and including the second day of July, 1970, to and including the day immediately before the commencement of these Regulations is, by force of this sub-regulation, entitled to be paid, as additional flight pay, an amount equal to the amount by which the amount of flight pay paid or payable to him in respect of that day is less than the amount of flight pay that would have been payable to him in respect of that day if the amendment of the Air Force Regulations effected by the last preceding sub-regulation had come into operation on the second day of July, 1970.

(3.) An airman of the Permanent Air Force who was undergoing training of a kind referred to in regulation 553c of the Air Force Regulations as amended by these Regulations during the period from and including the second day of July, 1970, to and including the day immediately before the commencement of these Regulations or during a part of that period is entitled to be paid flight training pay in respect of that period or that part of that period, as the case may be, as if the amendment of the Air Force Regulations effected by sub-regulation (1.) of this regulation had come into operation on the second day of July, 1970.

Addition to flying instructional pay, flying pay, flight pay or flight training pay.

5.—(1.) Regulation 554 of the Air Force Regulations is amended—

(a)by omitting the words " flying pay or flight pay " and inserting in their stead the words " flying pay, flight pay or flight training pay "; and

(b) by omitting the word and figures " 553a or 553b " and inserting in their stead the word and figures " 553a, 553b or 553c ".

(2.) Where an airman of the Permanent Air Force is entitled to be paid flight training pay in respect of a day in the period from and including the second day of July, 1970, to and including the day immediately before the commencement of these Regulations, the flight training pay payable to him in respect of that day may be increased by the amount, if any, by which it could have been increased if the amendments of the Air Force Regulations effected by regulations 4 and 5 of these Regulations had come into operation on the second day of July, 1970.

Rates of higher duty allowance.

6. Regulation 556K of the Air Force Regulations is amended—

(a) by inserting in paragraph (a) of sub-regulation (2.), after the word " payable " (second occurring), the words " to the member ";

(b) by omitting from paragraph (b) of sub-regulation (2.) the words " the rank of group captain " and inserting in their stead the words " the prescribed rank in relation to the member ";

(c) by omitting from paragraph (c) the words " a rank below the rank of air commodore " and inserting in their stead the words " the prescribed rank in relation to the member or a lower rank "; and

(d) by inserting after sub-regulation (2.) the following sub-regulation:—

 " (2a.) For the purpose of the last preceding sub-regulation, the prescribed rank, in relation to a member, is—

(a) if the member is a male officer of the medical branch who is a qualified medical practitioner or dental practitioner—the rank of squadron leader; or

 

(b)in the case of any other member—the rank of group captain.".

Fifth and Sixth Schedules.

7. The Fifth and Sixth Schedules to the Air Force Regulations are repealed and the following Schedules inserted in their stead:—

Transitional.

8.—(1.) The rates of active pay provided for in the Air Force Regulations as amended by sub-regulations (1.), (2.), (3.), (4.), (6.) and (7.) of regulation 1, and by regulation 7, of these Regulations apply to and in relation to service in the Air Force on and after the tenth day of September, 1970.

(2.) A male officer of the medical branch in receipt of active pay in respect of his service on a day in the period from and including the tenth day of September, 1970, to and including the day immediately before the commencement of these Regulations, being a male officer who, on that day, was a qualified medical practitioner or dental practitioner and held the rank of squadron leader or flight lieutenant is, by force of this sub-regulation, entitled to be paid active pay in respect of that day at the rate specified in sub-regulation (7.) of regulation 543 of the Air Force Regulations as amended by these Regulations in relation to the rank that he held on that day and his service in that rank on that day instead of at the rate applicable under the Air Force Regulations as in force on that day.

(3.) A male officer of the medical branch in receipt of active pay in respect of his service on a day in the period from and including the eighteenth day of

 

December, 1969, to and including the ninth day of September, 1970, being a male officer who, on that day, was a qualified medical practitioner or dental practitioner and held the rank of squadron leader or flight lieutenant is, by force of this sub-regulation, entitled to be paid active pay in respect of that day at the rate specified in the second column or third column, whichever is appropriate, of the following table in relation to the rank that he held on that day and his service in that rank on that day instead of at the rate provided for in the Air Force Regulations as in force on that day.

(4.) Where a male member of the medical branch held, during the period from and including the eighteenth day of December, 1969, to and including the day immediately before the commencement of these Regulations or during a part of that period, the rank of group captain or wing commander and the member was a qualified medical practitioner or dental practitioner, the member is entitled to be paid in respect of his service during that period while holding such a rank, as additional active pay, an amount equal to the amount by which the sum of the active pay and allowances paid or payable to him in respect of that service is less than the sum of the active pay and allowances that would have been payable to him in respect of that service if the Air Force Regulations as amended by Statutory Rules 1970, No. 132, and these Regulations had been in force throughout that period.

(5.) In calculating the amount of active pay and allowances that would have been payable to a male member of the medical branch in respect of service to which the last preceding sub-regulation relates under the Air Force Regulations as amended by Statutory Rules 1970, No. 132, and these Regulations, it shall be assumed—

(a)that the amount specified in the table in sub-regulation (3.) of regulation 544 of the Air Force Regulations as so amended in relation to the rank of group captain was—

(i) on the eighteenth day of December, 1969—Twelve thousand nine hundred and thirty-five dollars; and

(ii) on and after the nineteenth day of December, 1969—Thirteen thousand three hundred and twenty-three dollars; and

(b) that the amount specified in that table in relation to the rank of wing commander was—

(i) on the eighteenth day of December, 1969—Eleven thousand nine hundred and sixty dollars; and

(ii) on and after the nineteenth day of December, 1969—Twelve thousand three hundred and nineteen dollars.

 

(6.) Higher duty allowance payable to amember in respect of a day in the period from and including the eighteenth day of December, 1969, to and including the day immediately before the commencement of these Regulations is payable as if the amendments of regulation 556k of the Air Force Regulations effected by Statutory Rules 1970. No. 132, and regulation 6 of these Regulations had come into operation on the eighteenth day of December, 1969.
