REGULATIONS UNDER THE AIR FORCE ACT 1923-1965.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923-1965.

2. Regulation 544 of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “ Fifteen thousand four hundred and sixty-nine dollars ” and inserting in their stead the words “ Sixteen thousand three hundred and ninety-seven dollars ”; and

(b) by omitting from sub-regulation (2.) the words “ Thirteen thousand and thirty-eight dollars ” and inserting in their stead the words “ Thirteen thousand eight hundred and twenty dollars ”.

Pay of airmen other than cadets and apprentices.

3. Regulation 549 of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “ or Part V.” and inserting in their stead the words “ Part V., Part VI., Part VII. or Part VIII.”;

(b) by omitting from sub-regulation (2.) the words “ holding a rank other than Aircraftwoman (Recruit) ” and inserting in their stead the words “, other than an airwoman holding the rank Aircraftwoman (Recruit) or mustered as a Telephone Operator or Accounting Machine Operator,”; and

(c) by inserting after sub-regulation (2A.) the following sub-regulation:—

“ (2b.) The daily rate of active pay of an airwoman of the Permanent Air Force mustered as a Telephone Operator is the rate specified in the following table in relation to her rank and, if relevant, her length of service in her rank.

5. Regulation 555 of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (2.) the words “ One dollar fifteen cents ” and inserting in their stead the words “ One dollar twenty-five cents ”;

(b) by omitting from paragraph (b) of sub-regulation (3.) the words “ One dollar seventy cents ” and inserting in their stead the words “ One dollar eighty cents ”;

(c) by omitting from paragraph (d) of sub-regulation (3.) the words “ One dollar seventy cents ” and inserting in their stead the words “ One dollar eighty cents ”;

(d) by omitting from paragraph (e) of sub-regulation (3.) the words “ One dollar fifteen cents ” and inserting in their stead the words “ One dollar twenty-five cents ”;

(e) by omitting from paragraph (b) of sub-regulation (5.) the words “ One dollar seventy cents ” and inserting in their stead the words “ One dollar eighty cents ”;

6. Regulation 555A of the Air Force Regulations is amended by omitting from paragraph (a)of sub-regulation (2.) the words “ Three dollars fifty-five cents ” and inserting in their stead the words “ Three dollars seventy-five cents ”.

Living out allowance—single members.

7. Regulation 567 of the Air Force Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “ One dollar twenty-two cents ” and inserting in their stead the words “ One dollar thirty-two cents ”;

(b) by omitting from sub-paragraph (i) of paragraph (b) of that sub-regulation the words “ One dollar eighty-five cents ” and inserting in their stead the words “ One dollar ninety-five cents ”; and

(c) by omitting from sub-paragraph (ii) of paragraph (b) of that sub-regulation the words “ One dollar twenty-two cents ” and inserting in their stead the words “ One dollar thirty-two cents ”.

Ration allowance.

8. Regulation 569 of the Air Force Regulations is amended—

(a) by omitting from paragraph (d) of sub-regulation (2.) the words “ One dollar twenty-two cents ” and inserting in their stead the words “ One dollar thirty-two cents ”;

(b) by omitting from sub-paragraph (i) of paragraph (e) of that sub-regulation the words “ One dollar eighty-five cents ” and inserting in their stead the words “ One dollar ninety-five cents ”; and

(c) by omitting from sub-paragraph (ii) of paragraph (e) of that sub-regulation the words “ One dollar twenty-two cents ” and inserting in their stead the words “ One dollar thirty-two cents ”.

Rates of travelling allowance.

9. Regulation 578 of the Air Force Regulations is amended by omitting from paragraph (b) of sub-regulation (3.) the words “ One dollar twenty-two cents ” and inserting in their stead the words “ One dollar thirty-two cents ”.

Reduction of rate where subsistence or quarters is provided.

10. Regulation 590 of the Air Force Regulations is amended by omitting from sub-regulation (4.) the words “ One dollar twenty-two cents ” and inserting in their stead the words “ One dollar thirty-two cents ”.

11. The Fifth and Sixth Schedules to the Air Force Regulations are repealed and the following Schedules inserted in their stead:—

Application.

12.—(1.) The rates of pay and rates of allowances provided for in the Air Force Regulations as amended by regulations 1 to 9 (inclusive) and regulation 11 of these Regulations apply in respect of service in the Air Force on and after the first day of January 1971.

(2.) Where, but for this sub-regulation, a male member would, by virtue of the application of the amendments of regulation 555 or regulation 555a of the Air Force Regulations as from the first day of January, 1971, in accordance with sub-regulation (1.) of this regulation cease to be entitled to marriage allowance or become entitled to marriage allowance at a reduced rate, the member shall not cease to be so entitled to marriage allowance or the rate of marriage allowance shall not be so reduced, as the case may be, until the date of commencement of these Regulations.

(3.) Where an allotment made by a male member was in force in respect of the period from and including the first day of January 1971, to and including the day immediately before the commencement of these Regulations, or in respect of a part of that period, at a rate that entitled him to marriage allowance at the rate of One dollar fifteen cents per day but would not entitle him to marriage allowance at the rate of One dollar twenty-five cents per day under the

Air Force Regulations as amended by these Regulations, the member may increase his allotment in respect of the period or the part of the period, as the case may be, and, if he does so, marriage allowance is payable to him in accordance with the Air Force Regulations as so amended as if his increased allotment had been in force during the period or the part of the period.

Transitional—officers and chaplains.

13.—(1.) Where a male officer of the Air Force was in receipt of active pay in respect of service in that Force at any time during the period from and including the seventeenth day of December, 1970, to and including the thirty-first day of December, 1970, in accordance with—

(a) sub-regulation (1.) of regulation 543 of the Air Force Regulations;

(b) sub-regulation (4.) of that regulation;

(c) sub-regulation (5.) of that regulation; or

(d) sub-regulation (6.) of that regulation,

the next succeeding sub-regulation applies to that service of the officer.

(2.) Where a male officer of the Air Force was in receipt of active pay in respect of service to which this sub-regulation applies and the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to be paid active pay—

(a) in the case of an officer referred to in paragraph (a) or (c) of the last preceding sub-regulation—at the rate per day specified, in relation to his rank and his length of service in his rank in the First Schedule to these Regulations;

(b) in the case of an officer referred to in paragraph (b) of the last preceding sub-regulation—at the rate of Fifteen dollars four cents per day; or

(c) in the case of an officer referred to in paragraph (d) of the last preceding sub-regulation—at the rate of Twelve dollars seventy-nine cents per day,

exceeds the sum of the active pay paid or payable to him in respect of that service, the officer is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.

(3.) Where an officer of the chaplains’ branch of the Permanent Air Force was in receipt of active pay in respect of service in that Force at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (8.) or (8a.) of regulation 543 of the Air Force Regulations, the officer is entitled to be paid in respect of that service, as additional active pay, an amount equal to the amount by which the sum of the active pay paid or payable to him, but for this sub-regulation, in respect of that service is less than the sum of the active pay that would have been payable to him in respect of that service if he had been entitled to be paid active pay—

(a) in the case of an officer in receipt of active pay in accordance with sub-regulation (8.) of regulation 543 of the Air Force Regulations—at the rate specified in the Second Schedule to these Regulations in relation to his length of service in the rank of chaplain; or

(b) in any other case—at the rate of Twenty-six dollars thirty-five cents per day.

(4.) Where an officer of the Royal Australian Air Force Nursing Service or the Women’s Royal Australian Air Force was in receipt of active pay in respect of service in the Air Force at any time during the period specified in sub-regulation (1.) of this regulation in accordance with sub-regulation (9.) of regulation 543 of the Air Force Regulations, the officer is entitled to be paid in respect of that service, as additional active pay, an amount equal to the amount by which the sum of the active pay paid or payable to her, but for this sub-regulation, in respect of that service is less than the sum of the active pay that

would have been payable to her in respect of that service if she had been entitled to be paid active pay at the rate per day specified in relation to her rank and her length of service in her rank in the Third Schedule to these Regulations.

Transitional—Airwomen.

14.—(1.) Each of the following periods is a period to which this regulation applies:—

(a) the period from and including the first day of October, 1969, to and including the eighteenth day of December, 1969;

(b) the period from and including the nineteenth day of December, 1969, to and including the thirty-first day of December, 1969;

(c) the period from and including the first day of January, 1970, to and including the ninth day of September, 1970; and

(d) the period from and including the tenth day of September, 1970, to and including the thirty-first day of December, 1970.

(2.) Subject to the next succeeding sub-regulation, where an airwoman was in receipt of active pay in respect of service in the Air Force in a period to which this regulation applies in accordance with the Sixth Schedule to the Air Force Regulations and the sum of the active pay that would have been payable to her in respect of that service if she had been entitled to be paid active pay at the rate per day specified, in relation to her rank and her length of service in her rank (where relevant) and to the group in which her mustering was classified—

(a) in the case of the period referred to in paragraph (a) of the last preceding sub-regulation—in the Fourth Schedule to these Regulations;

(b) in the case of the period referred to in paragraph (b) of the last preceding sub-regulation—in the Fifth Schedule to these Regulations;

(c) in the case of the period referred to in paragraph (c) of the last preceding sub-regulation—in the Sixth Schedule to these Regulations; or

(d) in the case of the period referred to in paragraph (d) of the last preceding sub-regulation—in the Seventh Schedule to these Regulations,

exceeds the sum of the active pay paid or payable to her, but for this sub-regulation, in respect of that service, the airwoman is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.

(3.) The last preceding sub-regulation does not apply in relation to the service of an airwoman who was mustered as a Telephone Operator or Accounting Machine Operator.

(4.) Sub-regulation (2a.) of regulation 549 of the Air Force Regulations applies to the service of an airwoman of the Permanent Air Force holding the rank of Aircraftwoman (Recruit) during a period to which this regulation applies as if the reference to the daily rate of active pay specified in Part I. of the Sixth Schedule to the Air Force Regulations were read as a reference to the daily rate of active pay specified in Part I. of the Fourth, Fifth, Sixth or Seventh Schedule to these Regulations, whichever is applicable to that period.

(5.) Where an airwoman was in receipt of active pay in respect of service in the Air Force at any time during a period to which this regulation applies in accordance with sub-regulation (4.) of regulation 549 of the Air Force Regulations and the sum of the active pay that would have been payable to her in respect of that service if she had been entitled to be paid active pay at the rate per day specified in relation to her rank and her length of service in her rank (where relevant) in the Fourth, Fifth, Sixth or Seventh Schedule to these Regulations, whichever is applicable to that period, exceeds the sum of the active pay paid or payable to her in respect of that service, the airwoman is entitled to be paid an amount equal to the excess as additional active pay in respect of that service.
