REGULATIONS UNDER THE AIR FORCE ACT 1923-1965.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Air Force Act 1923-1965.

Amendments of the Air Force Regulations 

Chaplains—precedence.

1. Regulation 51 of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (2) the words “a chaplain” (first occurring) and substituting the words “a chaplain in the Permanent Air Force”; and

(b) by adding at the end thereof the following sub-regulations:—

“(3) For the purpose of precedence, a chaplain in the Citizen Air Force or in the Air Force Emeregency Force, other than a chaplain who holds an appointment of Principal Air Chaplain, shall, subject to sub-regulation (5), be deemed to hold a rank that corresponds with the rank specified in the second column of the following table in relation to his length of service:—

“(4) For the purposes of sub-regulation (3), ‘length of service’, in relation to a chaplain, means the sum of—

(a) a period equal to the length of his service, other than continuous full-time service, as a chaplain in the Defence Force; and

(b) a period equal to twice the length of his continuous full-time service (if any) as a chaplain in the Defence Force.

“(5) Where, immediately before being appointed to the rank of chaplain in the Citizen Air Force or in the Air Force Emergency Force, a person held the rank of Chaplain in the Permanent Air Force and was, by virtue of sub-regulation (2), deemed, for the purpose of precedence, to hold a rank corresponding to a rank higher than the rank of Squadron Leader, he shall, for the purpose of precedence as a member of the Citizen Air Force or of the Air Force Emergency Force, be deemed to hold that higher rank.”.

Precedence of officers.

2. Regulation 466 of the Air Force Regulations is amended by inserting after sub-regulation (1) the following sub-regulation:—

“(1a) For the purposes of sub-regulation (1), an officer of the Reserve who holds the rank of chaplain and is, by virtue of regulation 51 deemed to hold a rank corresponding to another rank shall be deemed to hold that other rank.”.

Unclaimed pay and allowances.

3. Regulation 529 of the Air Force Regulations is repealed.

Rates of pay.

4. Regulation 645 of the Air Force Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (1) the word “Permanent” and substituting the word “Citizen”; and

(b) by omitting sub-regulations (2) and (3).

Rates of pay.

5. Regulation 646 of the Air Force Regulations is amended—

(a) by omitting sub-regulations (1) to (3a) (inclusive) and substituting the following sub-regulations:—

“(1) A member of the Citizen Air Force who renders service, other than continuous full-time service, shall be paid active pay in respect of that service at the rate fixed in accordance with this regulation.

“(2) Subject to sub-regulations (2b), (2c), (2d) and (2e), the rate at which active pay is payable to a male member who is an officer in respect of service referred to in sub-regulation (1) is the daily rate specified in column 2 of the following table opposite the description of the rank held by the officer in column 1 of that table:—

“(2a) Subject to sub-regulations (2b), (2c), (2d) and (2e), the rate at which active pay is payable to a female member who is an officer in respect of service referred to in sub-regulation (1) is the daily rate specified in column 2 of the following table opposite to the description of the rank held by the officer in column 1 of that table:—

“(2b) The rate at which active pay is payable to a member who is the Citizen Air Force Member of the Air Board is Six hundred and seventy dollars per year.

“(2c) The rate at which active pay is payable to a member who is a qualified medical practitioner or a qualified dental practitioner and is serving as an officer in the Medical Branch in respect of service referred to in sub-regulation (1) is the daily rate specified in column 2 of the following table opposite to the description of the rank held by the officer in column 1 of that table:—

“(2d) The rate of active pay payable to an officer of the Chaplians’ Branch of the Citizen Air Force who holds an appointment of Principal Air Chaplain is Thirty dollars twenty-four cents per day.

“(2e) The rate of active pay payable to an officer of the Chaplains’ Branch of the Citizen Air Force, not be an officer who holds the appointment of Principal Air Chaplain, is the daily rate specified in the following table in relation to his length of service:—

“(2f) For the purposes of sub-regulation (2e), ‘length of service’, in relation to a chaplain, means the sum of—

(a) a period equal to the length of this service, other than continuous full-time service, as a chaplain in the Defence Force;

(b) a period equal to twice the length of his continuous full-time service as a chaplain in the Defence Force.

“(2g) Subject to sub-regulation (2h), the daily rate of active pay payable to a member who is an airman in respect of service referred to in sub-regulation (1) is—

(a) in the case of a member who holds a rank specified in Part I of the Seventh Schedule—the rate specified in that Part in relation to the rank held by the member and the pay level appropriate, under regulation 549 in its application to a member rendering service referred to in sub-regulation (1), to the member;

(b) in the case of a member who holds a rank specified in Part II of the Seventh Schedule—the rate specified in column 2 of that Part opposite to the description of the rank held by the member in column 1 of that Part; and

(c) in the case of a member who holds the rank of Sergeant—the appropriate rate.

“(2h) The daily rate of active pay payable to a member who is an airman and holds the rank of Aircraftman (Recruit) in respect of service referred to in sub-regulation (1) is Seven dollars twenty-five cents.

“(3) The ‘appropriate rate’ for the purposes of paragraph (c) of sub-regulation (2g) is—

(a) in the case of an airman who, immediately before the commencement of this sub-regulation, held the rank of Sergeant and was paid at a rate specified in a paragraph in the second column of the table in sub-regulation (1) of regulation 549a—the rate specified in the paragraph in column 2 of Part III of the Seventh Schedule designated by the same letter as that first-mentioned paragraph; or

(b) in the case of an airman who, after the commencement of this sub-regulation, is promoted to, or enlists with, the rank of Sergeant—the rate that would be applicable to the airman if—

(i) regulation 549a (in so far as that regulation is expressed to apply to an airman promoted to or enlisting with the rank of Sergeant) applied to the airman;

(ii) a reference to the prescribed table in that regulation were read as a reference to Part III of the Seventh Schedule;

(iii) a reference to a rate specified in a paragraph in the second column of item 3 of that table (however expressed) were read as a reference to the rate specified in a paragraph in column 2 of that Part;

(iv) sub-regulation (1) and sub-regulations (6) to (16) (inclusive) of that regulation were omitted; and

(v) the reference in that regulation to regulation 549b were omitted.”; and

(b) by omitting sub regulation (5) and substituting the following sub-regulations:—

“(5) The provisions of regulation 549 apply to and in relation to members of the Citizen Air Force as if—

(a) sub-regulations (1), (2) and (3) were omitted; and

(b) the words ‘the Fifth Schedule or Sixth Schedule to these Regulations, the pay level referred to in those Schedules’ in sub-regulation (5) were omitted and the words ‘Part I of the Seventh Schedule, the pay level’ were substituted.

“(6) For the purposes of this regulation, an Air Cadet in the Citizen Air Force shall be deemed to hold the rank of Aircraftman (Recruit) in the Citizen Air Force.”.

Seventh Schedule.

6. After the Sixth Schedule to the Air Force Regulations the following Schedule is inserted:—
