Air Force Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923.

Power to appoint and promote officers

1. Regulation 45 of the Air Force Regulations is amended by inserting “, by instrument in writing” after “Regulations”.

Extension of appointments

2. Regulation 47 of the Air Force Regulations is amended—

(a) by omitting “the Governor-General may” and substituting “the Chief of the Air Staff may, by instrument in writing,”; and

(b) by omitting “may” (last occurring).

Resignation of officers

3. Regulation 73 of the Air Force Regulations is amended—

(a) by inserting in sub-regulation (2) “by instrument in writing and” after “may,”;

(b) by inserting in paragraph (3) (a) “, by instrument in writing,” after “may”; and

(c) by inserting in sub-regulation (5) “, by instrument in writing,” after “may”.

4.Regulation 86 of the Air Force Regulations is repealed and the following regulation substituted:

Retired List

“86. (1) The Chief of the Air Staff may, by instrument in writing, place the names of officers or former officers on a Retired List.

“(2) A person whose name has been placed on a Retired List under sub-regulation (1) is not, by reason only of being placed on that list, a member of the Air Force or the Defence Force.”.

Retiring ages for officers

5. Regulation 88 of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (2) “the Governor-General may” and substituting “the Minister may, by instrument in writing,”; and

(b) by omitting from paragraph (3) (b) “be retired by the Governor-General” and substituting “be retired by the Minister, by instrument in writing,”.

Retirement of Principal Air Chaplain

6. Regulation 88A of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (2) “Governor-General” and substituting “Minister”; and

(b) by omitting from sub-regulation (3) “The Governor-General may” and substituting “The Minister may, by instrument in writing”.

Air force title after retirement

7. Regulation 88b of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (1) “the Governor-General shall, if he places an officer on a Retired List, grant to that officer” and substituting “the Chief of the Air Staff shall, if he places the name of an officer or a former officer on a Retired List, grant to that officer or former officer”;

(b) by omitting from sub-regulation (2) “The Governor-General shall, if he places an officer on a Retired List, grant to that officer” and substituting “The Chief of the Air Staff shall, if he places the name of an officer or a former officer on a Retired List, grant to that officer or former officer”;

(c) by inserting in sub-regulation (2) “or former officer” after “that officer” (second occurring); and

(d) by omitting sub-regulation (3) and substituting the following sub-regulation:

“(3) The Chief of the Air Staff shall, if he places the name of a person who is or was a Principal Air Chaplain or Chaplain on a Retired List, grant to that person the air force title of Chaplain.”.

Re-engagement of airmen

8. Regulation 106 of the Air Force Regulations is amended by inserting in sub-regulation (1) “, by instrument in writing,” after “shall”.

Retiring age for airmen

9. Regulation 118 of the Air Force Regulations is amended by omitting from sub-regulation (2) “the Governor-General may” and substituting “the Minister may, by instrument in writing,”.
