Air Force Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923.

Interpretation

1. Regulation 4 of the Air Force Regulations is amended—

(a) by omitting from sub-regulation (1) the definition of “air cadet”; and

(b) by omitting from paragraph (9) (c) “(h),”.

Ranks of officers

2. Regulation 50 of the Air Force Regulations is amended—

(a) by adding at the end of the table in sub-regulation (1) the following item:

“12 Officer Cadet ”; and

(b) by omitting sub-regulation (3).

Repeal of regulation 50a

3. Regulation 50a of the Air Force Regulations is repealed.

4. Regulations 52, 52a, 53, 54, 54aa and 54a of the Air Force Regulations are repealed and the following regulation is substituted:

Chief of the Air Staff to make determinations

“52. (1) Subject to sub-regulations (2) and (3), the Chief of the Air Staff may determine by instrument in writing that—

(a) persons; or

(b) persons included in a class of persons specified in the instrument, are not eligible for appointment—

(c) to ranks specified in the instrument;

(d) in parts of the Air Force specified in the instrument; or

(e) of a kind specified in the instrument,

unless they meet the conditions of appointment specified in the instrument.

“(2) In making a determination under sub-regulation (1), the Chief of the Air Staff shall have regard to the education, training, experience or other qualifications required to make a person suitable for the appointment concerned.

“(3) The Chief of the Air Staff may, having regard to a person’s education, training, experience or other qualifications, exempt that person from compliance with a determination made under sub-regulation (1).”.

Appointments to be on probation

5. Regulation 55 of the Air Force Regulations is amended by omitting sub-regulation (1) and substituting the following sub-regulation:

“(1) A person appointed to be an officer shall be appointed on probation—

(a) in the case of a person appointed with the rank of Officer Cadet—while he holds that rank and for the immediately succeeding period of 2 years; or

(b) in any other case—for any period of initial training not exceeding a period of 1 year and for the immediately succeeding period of 2 years.”.

Retiring ages for officers

6. Regulation 88 of the Air Force Regulations is amended by adding at the end of the table in sub-regulation (1)—

Repeal of regulations 97 and 97a

7. Regulations 97 and 97a of the Air Force Regulations are repealed.

Ranks of airmen

8. Regulation 101 of the Air Force Regulations is amended by omitting paragraphs (1) (g) and (h) and substituting the following paragraph:

“(g) Non-commissioned Officer Cadet;”.
