Air Force Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923.

1. After regulation 153 of the Air Force Regulations the following regulation is inserted in Division 1 of Part VI:

Condonation no bar to proceedings

“154. Proceedings before a court-martial in the Air Force under the Air Force Act for an offence shall not be barred on the ground of condonation of the offence.”.

Schedule 3

2. Schedule 3 to the Air Force Regulations is amended by inserting after modification (ad) the following modification:

“(ada)

Omit paragraph (a) (ii).”

Schedule 4

3. Schedule 4 to the Air Force Regulations is amended—

(a) by omitting the last modification of paragraph 1111 and substituting—

“Omit from clause 9 the words ‘If by error, or in emergency, he has been ordered to perform any duty, he is not thereby absolved from liability to be proceeded against for the offence for which he is under arrest.’.

Omit clause 12.”; and

(b) by omitting from the modification of paragraph 1154 all the words from and including “‘2. Great care’ to and including ‘under the Act.”.’.
