REGULATIONS UNDER THE AIR FORCE ACT 1923.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923, to come into operation forthwith.

Amendment of Air Force Regulations.

(Statutory Rules 1927, No. 161, amended to this date.)

(Thirteenth Amendment.)

1. Regulation 54b. is amended by omitting from proviso (1.) of sub-regulation (2.) the word “duties” (second occurring).

2. After Regulation 74 the following new regulation is inserted:—

Marriage of personnel undergoing flying training.

74a.—(1.) Except as provided in the next succeeding sub-regulation a member who marries while undergoing a flying training course, shall—

(a) If an officer seconded from the Naval or Military Forces, be liable to have his secondment terminated;

(b) If an officer other than one referred to in the last preceding paragraph, be liable to have his appointment terminated;

(c) If an air cadet other than one referred to in the next succeeding paragraph, be liable to be discharged; or

(d)If an airman appointed as air cadet or an airman being trained as airman pilot, be liable to be reverted to the normal duties of his mustering.

(2.) The last preceding sub-regulation shall not apply to an officer of the medical branch or the stores and accounting branch who is undergoing a flying training course, other than to qualify for appointment or transfer to the general duties branch.”

3. Regulation 170 is amended by omitting from paragraph (c) the words “the Commissioners of”

4. Regulation 190 is amended—

(a)by omitting from paragraph (xxiii) the words “money or goods” and inserting in their stead the word “property”;

(b)by omitting from paragraph (xxiii) the words “such goods” and inserting in their stead the words “such property”; and

(c) by omitting paragraph (xxvii) and inserting in its stead the following paragraph:—

“(xxvii) Steals, embezzles, or fraudulently misapplies or receives, knowing it to have been stolen or embezzled, any property belonging to a person subject to air-force law, or to any service mess or band, or to any service institution or canteen or any public property;”.

5. Regulation 192 is amended—

(a)by omitting from paragraph (vi) the words “His Majesty’s Forces or any part thereof” and inserting in their stead the words “His Majesty’s Forces, or any forces co-operating therewith, or any part of any such forces”;

(b) by inserting in paragraph (xxiii) after the word “forces” the words “whether His Majesty’s Forces or forces co-operating therewith”; and

(c) by inserting in paragraph (xxiv) after the word “forces” the words “whether His Majesty’s Forces or forces co-operating therewith”.

6. Regulation 236 is amended—

(a)by omitting from sub-regulation (1.) the words “admonished, reprimanded or severely reprimanded” and inserting in their stead the words “severely reprimanded, reprimanded, or admonished”; and

(b) by omitting from sub-regulation (2.) the words “admonished or reprimanded” and inserting in their stead the words “reprimanded or admonished”.

7. Regulation 323 is amended by omitting from sub-regulation (1.) the words “is offered or if such plea, being offered, is not overruled” and inserting in their stead the words “is not offered, or if such plea, being offered, is overruled”.

8. Regulation 364 is amended—

(a) by omitting from paragraph (a) of sub-regulation (1.) the words “reprimand or severe reprimand” and inserting in their stead the words “severe reprimand or reprimand”; and

(b)by omitting sub-paragraph (iii) from paragraph (b) of sub-regulation (1.) and inserting in its stead the following sub-paragraph:—

“(iii) in the case of a warrant officer or non-commissioned officer—

(1.) reduction to the ranks or to a lower grade, or forfeiture in the prescribed manner of seniority of rank; or

(2.) severe reprimand or reprimand;”.

9. Regulation 366 is amended by omitting sub-paragraph (i) from paragraph (b)and inserting in its stead the following sub-paragraph:—

“(i) by a district court-martial to be severely reprimanded or reprimanded or to such forfeitures, fines and stoppages as are prescribed, and either in addition to or in substitution for any such punishment, to be dismissed from the service, or, if he was originally enlisted as an aircraftman, but not otherwise, to be reduced to the ranks or in any case to be reduced to a lower grade or to an inferior class of warrant officer (if any), or to the bottom or any other place in the list of the rank which he holds; or”.

10. Regulation 391 is amended by omitting from sub-regulation (4.) the word “discharged” and inserting in its stead the word “released”.

11. Regulation 553 is amended by inserting in paragraph (a) beneath the word “Blacksmith” the word’s “Blacksmith and welder;”.

12. Regulation 629 is amended by omitting the table therefrom and inserting in its stead the following table:—

13. Regulation 650 is amended by inserting at the end of sub-regulation (3.) the following proviso:—

“Provided that a deduction shall not be made in respect of the first month of absence except when payment for that month is made to another member for performing the duties of the member on leave.”
