Air Force Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923.

Term, &c., of appointment

1. Regulation 46 of the Air Force Regulations is amended by inserting after sub-regulation (1) the following sub-regulation:

“(1a) In sub-regulation (1), a reference to the Governor-General shall, in the case of an appointment made by a delegate under regulation 45a, be read as a reference to that delegate.”.

2. (1) Regulation 48 of the Air Force Regulations is repealed and the following regulation is substituted:

Chaplains

“48. (1) The Governor-General may, under regulation 45, appoint a clergyman of a recognized religious denomination to be an officer in the chaplains branch of the Air Force.

“(2) A clergyman appointed to the chaplains branch of the Air Force under regulation 45 holds the rank of chaplain of the Air Force.”.

(2) Where, before the commencement of these Regulations, a person had been appointed to be a chaplain of the Air Force, and, immediately before that commencement, held the rank of chaplain of the Air Force, the repeal effected by sub-regulation (1) does not affect that appointment.

Principal air chaplains

3. (1) Regulation 48aof the Air Force Regulations is amended by omitting “Governor-General” from sub-regulation (1) and substituting “Chief of the Air Staff”.

(2) Where, immediately before the commencement of these Regulations, a person held an appointment as principal air chaplain, that appointment shall continue after that commencement as if that appointment had been made by the Chief of the Air Staff.

Appointments to be on probation

4. Regulation 55 of the Air Force Regulations is amended—

(a) by inserting in sub-regulation (2) or the Chief of the Air Staff,” after “Governor-General”;

(b) by inserting in sub-regulation (3) “, or the Chief of the Air Staff,” after “Governor-General”; and

(c) by inserting in sub-regulation (4) “, or the Chief of the Air Staff,” after “Governor-General”.

Transfers between parts and branches

5. Regulation 57 of the Air Force Regulations is amended—

(a) by omitting “may” from sub-regulation (1) and substituting “, or the Chief of the Air Staff, may, by instrument,”; and

(b) by inserting in sub-regulation (1) “or the Chief of the Air Staff, as the case may be,” after “Governor-General” (second occurring).

Acting appointments

6. Regulation 59a of the Air Force Regulations is amended by omitting sub-regulations (7), (8) and (9).

Repeal of regulation 60a

7. Regulation 60a of the Air Force Regulations is repealed.

Repeal of regulation 103

8. Regulation 103 of the Air Force Regulations is repealed.
