I, THE
MINISTER OF STATE FOR DEFENCE, hereby make the following Interim Determination
under section 12 of the
Dated 17 December 1984.

(a) by omitting from sub-regulation (1) “salary and allowances shall, subject to sub-regulation (1a),” and substituting “allowances shall”;
(b) by omitting sub-regulation 1a;
(c) by omitting from sub-regulations (3), (4) and (5) “salary and” (wherever occurring); and
(d) by omitting sub-regulation (6) and substituting the following sub-regulation:
“(6) Where a member who has been reported dead or missing is subsequently found to be alive and an amount is credited to the member under the provisions of Determination 0101, Salary of Permanent Force Members, made under section 58b of the
Defence Act 1903, that amount shall be subject to a deduction of any amount paid to the member under the provisions of—(a) the
Defence Force Retirement Benefits Act 1948 ;(b) Part III of the
Defence Force Retirement Benefits Act 1959 ;(c) the
Defence Force Retirement and Death Benefits Act 1973 ;(d) the
Repatriation Act 1920 ;(e) the
Repatriation (Far East Strategic Reserve) Act 1956 ;(f) the
Repatriation (Special Overseas Service) Act 1962 ;(g) the
Compensation (Commonwealth Government Employees) Act 1971; or(h) regulation 563.”.
