Air Force Regulations2 (Amendment)

I, THE ADMINISTRATOR OF THE GOVERNMENT of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Air Force Act 1923.

Commencement

1. These Regulations shall come into operation on 3 July 1985.

Amendments of the Air Force Regulations

2. The Air Force Regulations are amended as set out in the Schedule.

SCHEDULE Regulation 2

AMENDMENTS OF AIR FORCE REGULATIONS

Regulation 3—

Repeal the regulation.

Sub-regulation 4 (1)—

(a) Omit the definition of “active service”, substitute the following definition:

“ ‘active service’ has the same meaning as in the Defence Force Discipline Act 1982;”.

(b) Omit the definitions of “air-force convict”, “air-force offence”, “air-force prison”, “air-force prisoner”, “airman under sentence”, “airman under sentence of detention”, “air officer”, “air service” or “air-force service”, “civil prison”,

“commanding officer”, “custom of the service”, “defaulter”, “enemy”, “penal servitude prison”, “place of detention”, “place of imprisonment”, “proper air-force authority”, “subordinate commander”, “the Air Force Act”, “the Contract Board”, “the Rules of Procedure”, “war service”.

Regulations 12, 13, 13a and 13b—

Repeal the regulations.

Sub-regulation 50 (4)—

Omit “war”, substitute “active”.

Regulation 115—

After paragraph (d), insert the following paragraph:

“(da) having been absent without leave for a period exceeding 3 months;”.

Part Vb—

Repeal the Part.

Part VI—

Repeal the Part.

Regulation 446b—

Repeal the regulation.

Regulation 460—

Repeal the regulation.

Sub-regulation 515 (5)—

Omit “an air-force”, substitute “a service”.

Paragraph 515 (10) (b)—

Omit the paragraph, substitute the following paragraph:

“(b) ‘service tribunal’ has the same meaning as in the Defence Force Discipline Act 1982.”.

Sub-regulation 515 (12)—

Omit the sub-regulation.

Regulation 531—

Repeal the regulation.

Regulation 532—

Repeal the regulation.

Paragraph 537 (1) (a)—

Omit “imposed upon, or incurred by,”, substitute “incurred by”.

Paragraph 537 (1) (b)—

Omit the paragraph, substitute the following paragraph:

“(b) the deduction from that member’s salary of a fine imposed on the member or a sum ordered to be paid by him; or”.

Sub-regulation 537 (2)—

Omit the sub-regulation, substitute the following sub-regulation:

“(2) A member is not entitled to draw an advance against future salary and allowances while he is absent without leave or is imprisoned or detained.”.

Sub-regulation 560 (1)

Omit “or without other sufficient cause”.

Sub-regulation 560 (2)—

(a) Omit “or without a sufficient cause”.

(b) Omit “pay whether by award of his commanding officer or otherwise”, substitute “salary”.

Regulation 562—

Repeal the regulation, substitute the following regulation:

Reduction of allotment where pay account in debit

“562. Where a member’s pay account shows a debit balance a prescribed authority may direct that any allotment made by the member shall be reduced or suspended until the debit is liquidated.”.

Sub-regulation 632b (1)—

Omit “war”, substitute “active”.

Regulation 664

Repeal the regulation.

Forms 14 to 37 (inclusive) of Schedule 1—

Omit the Forms.

Schedules 2, 3 and 4—

Repeal the Schedules.
