REGULATIONS UNDER THE AIR FORCE ACT 1923-1956.*

"51.—(1.) The ranks or chaplains to the Air Force are as follows:—
Principal air chaplain.

"(2.) For the purposes of precedence, the ranks of chaplains to the Air Force shall correspond with other ranks of officers in accordance with the following scale:—

"527. In this Part, unless the contrary intention appears—
'Australia' includes the Territories of the Commonwealth;
'child' means a person who—
(
a) is a child (not being an ex-nuptial child), a stepchild or a legally adopted child, of a member; and(
b )is under the age of sixteen years;
'prescribed authority' means—
(
a ) the Minister;(
b ) the Air Board;(
c ) the Secretary to the Department of Air;(
d ) the Assistant Secretary (Finance);(
e ) the Chief Administrative Assistant (Branch of Air Member for Personnel);(
f ) the Director of Finance (Pay);(
g ) an Area Finance Officer;(
h ) an Assistant Area Finance Officer; or(
i ) a person who is appointed by the Minister or the Air Board to be a prescribed authority;
'separation', in relation to a member, means—
(
a )a legal separation effected by a judgment, order or decree of a court of competent jurisdiction; and(
b )any marital relationship in respect of which an order for maintenance is made by a court of competent jurisdiction, other than a divorce or an annulment of marriage,
and 'separated' has a corresponding meaning.".
"532a.—(1.) An allowance, called 'detention allowance', at the rate of Two shillings per day is payable to a member in respect of the third stage of a period for which the member is undergoing detention in a Military Corrective Establishment.
"(2.) For the purpose of the last preceding sub-regulation the Commandant of a Military Corrective Establishment shall determine the third stage of a period of a member's detention in that Establishment.".
"537.—(1.) Where a member's pay account shows a debit balance as a consequence of—
(
a )a forfeiture of pay imposed upon, or incurred by, him;(
b )the recovery of a fine inflicted upon him or of a sum of money ordered or awarded to be paid by him or stopped from his pay, by a court-martial or other competent authority; or(
c ) a deduction from his pay of an amount under regulation 561,
the member shall, subject to the next succeeding sub-regulation, be entitled to draw as an advance against future pay and allowances payable to him an amount equal to one-tenth of his daily rate of active pay in respect of each day during which his account continues to show that debit balance.
"(2.) A member is not entitled to draw an advance against future pay while he is absent without leave, is serving a sentence of penal servitude, imprisonment or detention or is held in custody under sentence of field punishment.".

"543.—(1.) Subject to sub-regulations (2.), (3.), (4.), (5.) and (6.) of this regulation, the daily rate of active pay of an officer of the Permanent Air Force other than an officer of a rank higher than Air Commodore, an officer of the chaplains' branch or an officer of the Women's Service holding a rank specified in sub-regulation (9.) or (10.) of this regulation, is the rate specified in relation to his rank and service in the table in this sub-regulation.

"(2.) The daily rate of active pay of an officer of the rank of flight lieutenant shall not be increased beyond the rates specified in sub-regulation (1.) of this regulation for an officer of the rank of flight lieutenant who has completed 4 years' service in that rank, unless the officer has passed such examinations enabling him to qualify for promotion to the rank of squadron leader as the Air Board determines.
"(3.) The daily rate of active pay of a pilot officer, flying officer or flight lieutenant—
(
a ) who was granted a commission in the Permanent Air Force on or before the thirty-first day of December, 1955, with the rank of pilot officer;(
b )who was at the date of his appointment enrolled as a student in the final year of a University course; and(
c ) who is not a graduate of the Air Force College,
is Four pounds ten shillings and two pence.
"(4.) The daily rate of active pay of an officer who—
(
a )is or has been granted a commission in the Permanent Air Force after the thirty-first day of December, 1955, with the rank of pilot officer;(
b )is or was at the date of his appointment enrolled as a student of science, engineering or medicine at a University or Technical College; and(
c ) is not a graduate of the Air Force College,
is the rate specified in relation to his category and service in the table in this sub-regulation.

"(5.) Subject to sub-regulation (6.) of this regulation, the total of the daily rate of active pay and flying pay (if any, at the rate specified in relation to his rank in the table contained in regulation 553a of these Regulations) of an officer of the Permanent Air Force commissioned from warrant or non-commissioned rank shall be not less than the rate of active pay, excluding any increase effected pursuant to sub-regulation (3.) of regulation 550 of these Regulations, payable, from time to time, to a member who holds the rank and mustering held, and has the service in that rank and mustering completed, by the member immediately before his appointment to commissioned rank.
"(6.) The daily rate of active pay of an officer of the Permanent Air Force who is commissioned in a branch other than the general duties branch from warrant or non-commissioned rank in an aircrew mustering shall be not less than the rate of active pay payable, from time to time, to a member of a ground mustering in Group 6 with the same rank held and service in that rank, as completed by the member immediately before his appointment to commissioned rank.
"(7.) Subject to sub-regulation (8.) of this regulation, the daily rate of active pay of an officer of the chaplains' branch of the Permanent Air Force is the rate specified in relation to his classification and service in the table in this sub-regulation.

"(8.) The daily rate of active pay of an officer of the chaplains' branch of the Permanent Air Force who is serving as a Chaplain, Third Class and has so served continuously since the fourteenth day of August, 1955, shall be not less than Five pounds four shillings and eight pence.
"(9.) The daily rate of active pay of an officer of the Royal Australian Air Force Nursing Service is the rate specified in relation to her rank and service in the table in this sub-regulation.

" 549.—(1.) " (3.) For the purposes of this regulation, the Minister shall determine the group within which any particular mustering shall be classified.
" (4.) An aircraftwoman (recruit) of the Permanent Air Force who is under the age of twenty-one years and who, as a result of conditions outside her own control fails to qualify for reclassification to aircraftwoman before completing six months' service may be paid the rate of active pay prescribed by sub-regulation (2.) of this regulation for an adult aircraftwoman (recruit), on and from the date on which she completes six months' service.".

"553b. Flight pay at the rate of Three shillings and sixpence per day is payable to a member of the Permanent Air Force who is not entitled to flying pay in accordance with regulation 553a of these Regulations or to active pay in accordance with regulation 550 of these Regulations, for the period of his appointment as a flight engineer, or loadmaster member, of an aircraft crew.".
"554. Subject to such conditions as the Air Board approves, the rate of flying instructional pay, flying pay or flight pay payable to a member of the Permanent Air Force under regulation 553, 553a or 553b, respectively, of these Regulations may be increased by an amount of One shilling and sixpence per day to meet the cost of premiums payable by that member in respect of insurance on his own life.
"555.—(1.) Subject to the next two succeeding regulations, an allowance, called 'marriage allowance', is payable to a male member of the Permanent Air Force in accordance with the succeeding provisions of this regulation.
"(2.) Marriage allowance is payable at the rate of Eight shillings per day to a member—
(
a ) who is married, is not separated from his wife and maintains his wife or his children;(
b )who is widowed, or deserted by his wife, and maintains his children; or(
c ) who is separated or divorced from his wife, or whose marriage has been annulled, and who has the custody of, and maintains, his children.
"(3.) Where—
(
a ) a member is separated from his wife;(
b )there is an order of a court against the member for the maintenance of his wife or children at a rate exceeding Thirteen shillings and six pence per day; and(
c ) an allotment in satisfaction of the court order has been made by the member and is in force,
marriage allowance is payable to the member at a rate—
(
d )equal to the amount by which the rate of the court order exceeds Thirteen shillings and six pence per day; or(
e ) of Eight shillings per day,
whichever is the less.
"(4.) Where the marriage of a member has been terminated by divorce or has been annulled and there are no children of the marriage or the annulled marriage, marriage allowance is not payable to the member.
"(5.) Where—
(
a ) the marriage of a member has been terminated by divorce or has been annulled;(
b )there is an order of a court against the member for the maintenance of his former wife and the children of the marriage or the annulled marriage or the maintenance of those children at a rate exceeding Thirteen shillings and six pence per day; and(
c ) an allotment in satisfaction of the court order has been made by the member and is in force,
marriage allowance is payable to the member at a rate—
(
d )equal to the amount by which the rate of the court order exceeds Thirteen shillings and sixpence per day; or(
e )of Eight shillings per day,
whichever is the less.
"(6.) Where a member has married more than once, the provisions of this regulation authorize payment of marriage allowance only in respect of the last marriage in respect of which he is eligible for an allowance in accordance with the preceding provisions of this regulation.
"555a.—(1.) Marriage allowance is not payable to a member unless he submits to a prescribed authority an application in accordance with a form approved by the Air Board.
"(2.) Marriage allowance is not payable to a member under sub-regulation (2.) of the last preceding regulation unless he makes an allotment—
(
a )in the case of a member who is not separated from his wife and maintains his wife or his children—to his wife or to a person approved by the prescribed authority at a rate not less than One pound eight shillings and sixpence per day for the maintenance of his wife or his children; or(
b )in any other case—to a person approved by the prescribed authority, at a rate which, in the opinion of the prescribed authority, is sufficient for the maintenance of his children.
"(3.) Where, in the opinion of the prescribed authority, there is no appropriate person to whom a member could make an allotment required under the last preceding sub-regulation, the prescribed authority may waive the obligation of the member to make an allotment.
"556.—(1.) Where an allotment has been authorized by a member for the purposes of regulation 555, marriage allowance is payable to the member from and including—
(
a ) the date as from which the allotment commences to be payable; or(
b )such other date as the prescribed authority determines, not being—(i) a date earlier than the date on which he became a member;
(ii) a date earlier than three months before the date as from which the allotment commences to be payable;
(iii) a date earlier than the date of the marriage; or
(iv) a date earlier than three months before the day on which the member applies for marriage allowance.
"(2.) Where the obligation of a member to make an allotment is waived under sub-regulation (3.) of the last preceding regulation, marriage allowance is payable to the member from and including such date as the prescribed authority determines, not being—
(
a )a date earlier than the date on which he became a member;(
b )a date earlier than the date of his marriage; or(
c ) a date earlier than three months before the date on which the member applies for marriage allowance.".
"556b.—(1.) Subject to this regulation, an allowance, called 'separation allowance', is payable at the rate of Seven shillings per day to a member of the Permanent Air Force who is in receipt of marriage allowance at the rate specified in sub-regulation (2.) of regulation 555 in respect of any period for which the member is, by reason of his air-force duty, required to live away from his home.
"(2.) Separation allowance is not payable to a member who is a widower or is deserted by, or is separated or divorced from, his wife, or whose marriage has been annulled, unless the member maintains a house or a flat for use as a home for himself and his children.
"(3.) Where a member, on account of living away from his home, is in receipt of separation allowance and the member—
(
a )is directed to live out at his home for a period of less than seventy-two consecutive hours; or
(
b )proceeds on leave of absence for recreation for a period not exceeding—(i) if rations and single quarters are available to him at his unit—seventy-two consecutive hours; or
(ii) in any other case—seven consecutive days,
separation
allowance continues to be payable in respect of that period, but, if the member
lives out at his home for a period exceeding the period specified in paragraph
(
"556c.—(1.) Subject to sub-regulation (2.) of this regulation, an officer of the medical branch of the Permanent Air Force who is a qualified medical or dental practitioner may be paid an allowance at the rate specified in relation to his rank in the following table:—

" (2.) Sub-regulation (1.) of this regulation does not operate so as to authorize payment of an allowance to a medical officer prescribed in sub-regulation (4.) of regulation 543 before the date of his appointment to a short service commission in the Permanent Air Force.".
"566.—(1.) Subject to the succeeding provisions of this regulation and regulation 571, an allowance, called 'provision allowance', at the rate of Seven shillings per day is payable to a member of the Permanent Air Force who is in receipt of marriage allowance at the rate specified in sub-regulation (2.) of regulation 555, in respect of any period of seventy-two consecutive hours or more for which—
(
a ) the member is living out and is not supplied with rations and single quarters; or(
b )rations and single quarters are not available to the member at his unit and the member—(i) is a widower or is deserted by or is separated or divorced from his wife or has had his marriage annulled; and
(ii) has children in his custody for whom he does not maintain a home but for whom he bears financial responsibility which in the opinion of a prescribed authority is satisfactory.
"(2.) If provision allowance is payable to a
member under paragraph (
"(3.) Where a member who is in receipt of provision allowance, is directed to live away from his home, or is supplied with rations and single quarters, for a period of less than seventy-two consecutive hours provision allowance continues to be payable in respect of that period, but if the
member lives away from his home or is supplied with rations and single quarters for a period of seventy-two consecutive hours or more, provision allowance is not payable in respect of any part of that period.
"(4.) If provision allowance is payable to a member under either of the last two preceding sub-regulations on account of living in single quarters, the member shall not be charged by the Commonwealth for meals or accommodation while living in those single quarters.
"(5.) Provision allowance is not payable to a member to whom separation allowance is payable under regulation 556b.
"567.—(1.) Subject to the succeeding provisions of this regulation and to regulation 571, an allowance, called 'living out allowance', is payable to a member of the Permanent Air Force serving in Australia who is not qualified to receive marriage allowance or is qualified to receive marriage allowance but not separation allowance or provision allowance in respect of any period of seventy-two consecutive hours or more for which single quarters are not available to him at his unit, or for which he is on leave of absence with pay, at the rate per day of—
(
a) if the member is not qualified to receive marriage allowance— Nine shillings and sixpence; or(
b ) if he is qualified to receive marriage allowance but not separation allowance or provision allowance—(i) the difference between the daily rate of marriage allowance payable to him in respect of that period and Fifteen shillings; or
(ii) Nine shillings and sixpence,
whichever is the less.
"(2.) Where a member to whom living out allowance is payable is supplied with single quarters at his unit for a period of less than seventy-two consecutive hours, living out allowance continues to be payable in respect of that period, but, if the member is supplied with single quarters at his unit for a period of seventy-two consecutive hours or more, living out allowance is not payable in respect of any part of that period.
"(3.) If living out allowance is payable to a member under the last preceding sub-regulation in respect of a period for which he is supplied with single quarters at his unit, the member shall not be charged by the Commonwealth for meals or accommodation while living in those single quarters.
"(4.) For the purposes of sub-regulation (1.) of this regulation, single quarters shall be deemed to be not available to a member if he has been granted permission to live out for not less than seventy-two consecutive hours because—
(
a )he has been granted leave with pay;(
b )his commanding officer and a prescribed authority are satisfied that there are strong compassionate reasons which make the member's presence at his home essential; or(
c ) his unit medical officer certifies that the member is suffering from an illness or condition the proper treatment of which requires the provision of a diet not available at the unit but available at the place at which the member proposes to obtain meals.
"(6) Subject to such conditions as the Air Board approves, the rate of living out allowance payable to a member under this regulation for the first sixty days of his residence in a locality may be increased by an amount calculated at a rate not exceeding Five pounds per week.
"567a.—(1.) Subject to sub-regulation (2.) of this regulation, a member of the Permanent Air Force serving in Australia who is not qualified to receive marriage allowance or is qualified to receive marriage allowance but not separation allowance or provision allowance and who proceeds on duty for a period to a locality other than his permanent locality of duty may be paid living out allowance at the rate appropriate to his category and circumstances as provided in sub-regulation (1.) of regulation 567 for that period if—
(
a ) he is not supplied with single quarters; or(
b )he is supplied with single quarters but immediately prior to proceeding away from his permanent locality of duty was in receipt of living out allowance under regulation 567.
"(2.) Payment of living out allowance under the preceding sub-regulation shall be in addition to any payment of travelling allowance for which the member may qualify under regulation 578 but shall not be in addition to any payment of living out allowance for which the member may qualify under regulation 567 for the same period and where the member is supplied with single quarters in the locality in which he is temporarily on duty, shall not be continued for more than thirty days.
"568.—(1.) Subject to the succeeding provisions of this regulation and to regulation 571, an allowance, called 'living out away from home allowance', is payable to a member of the Permanent Air Force serving in Australia to whom marriage allowance and separation allowance are payable and who is required to live away from home for service reasons in respect of any period of seventy-two consecutive hours or more for which rations and single quarters are not available to him at his unit at the rate specified in relation to his rank in the table in this sub-regulation.

"(2.) Where a member to whom living out away from home allowance is payable by reason that rations and single quarters are not available to him at his unit is supplied with rations and single quarters for a period of less than seventy-two consecutive hours, the allowance continues to be payable in respect of that period, but, if he is supplied with rations and
single quarters for a period of seventy-two consecutive hours or more, living out away from home allowance is not payable in respect of any part of that period.
"(3.) A member to whom living out away from home allowance is payable for a period for which he is supplied with rations and single quarters under the last preceding sub-regulation shall not be charged by the Commonwealth for meals and accommodation granted to him during that period.
"569.—(1.) Subject to this regulation and to regulation 571, an allowance, called 'ration allowance', is payable to a member of the Permanent Air Force to and in relation to whom this regulation applies.
"(2.) Where a member of the Permanent Air Force—
(
a )is serving in Australia;(
b ) is not qualified to receive marriage allowance, or is qualified to receive marriage allowance but not separation allowance or provision allowance; and(
c ) for a period of seventy-two consecutive hours or more receives single quarters but not rations at his unit or is granted permission to obtain his meals away from his unit,
ration allowance is payable to the member in respect of that period at the rate per day of—
(
d )if the member is not qualified to receive marriage allowance— Nine shillings and sixpence; or(
e ) if he is qualified to receive marriage allowance but not separation allowance or provision allowance—(i) the difference between the daily rate of marriage allowance payable to him in respect of that period and Fifteen shillings; or
(ii) Nine shillings and sixpence,
whichever is the less.
"(3.) Where a member of the Permanent Air Force—
(
a ) is serving in Australia;(
b )is in receipt of marriage allowance and separation allowance;(
c )for a period of seventy-two consecutive hours or more receives single quarters but not rations at his unit or is granted permission to obtain his meals away from his unit,
ration allowance is payable to the member in respect of that period at the rate of Twelve shillings per day.
"(4.) Where a member to whom ration allowance is payable is supplied with rations at his unit for a period of less than seventy-two consecutive hours, the allowance continues to be payable in respect of that period, but, if he is supplied with rations at his unit for a period of seventy-two consecutive hours or more, ration allowance is not payable in respect of any part of that period.
"(5.) A member to whom ration allowance is payable for a period for which he is supplied with rations at his unit under the last preceding sub-regulation shall not be charged by the Commonwealth for meals granted to him during that period.
"(6.) Ration allowance is not payable to a member in respect of any period of seventy-two consecutive hours or more during which he is on leave of absence.
"570.—(1.) Subject to the next succeeding sub-regulation and to regulation 571, an allowance, called 'lodging allowance', is payable to a member of the Permanent Air Force serving in Australia to whom marriage allowance and separation allowance are payable in respect of any period of seventy-two consecutive hours or more for which rations but not single quarters are available to him at his unit at the rate specified in relation to his rank in the table in this sub-regulation.

"(2.) Where a member to whom lodging allowance is payable by reason that rations but not single quarters are available to him at his unit is supplied with single quarters for a period of less than seventy-two consecutive hours, that allowance continues to be payable in respect of that period, but, if he is supplied with single quarters for a period of seventy-two consecutive hours or more, lodging allowance is not payable in respect of any part of that period.
"571.—(1.) The allowances authorized by regulations 566, 567, 568, 569 and 570 are not payable to a member of the Permanent Air Force in respect of a day on which—
(
a ) travelling allowance or meal allowance for three consecutive meals is granted to that member;(
b )he is provided with meals in a hospital, a prison, detention barracks or a mental institution; or(
c ) he is provided with meals at Commonwealth expense on board ship, train or aircraft.
"(2.) Payment of the allowances authorized by regulations 568, 569 or 570 to a member who is entitled to marriage allowance and separation allowance and who is entitled to have his family moved at public expense to the locality in which he is serving shall not be continued—
(
a ) for a continuous period exceeding six months without the approval of the Air Board; and(
b )for a continuous period exceeding twelve months without the approval of the Treasurer.
"571a.—(1.) Subject to this regulation, an allowance called 'retention of lodgings allowance' is payable to a member of the Permanent Air Force serving in Australia to and in relation to whom this regulation applies.
"(2.) Where a member is absent from his lodgings while accommodated in hospital and pays for the retention of his lodgings for the period of that absence and was, immediately prior to that absence, receiving living out allowance under regulation 567 of these Regulations, he shall be paid retention of lodgings allowance in respect of the period of that absence, or thirty consecutive days, whichever is the less, at the rate of Nine shillings and sixpence per day or at the same rate as the payments made by the member for the retention of his lodgings, whichever is the less.
"(3.) Where a member—
(
a ) is absent from his lodgings—(i) while accommodated in hospital;
(ii) on duty at a place other than his normal place of duty; or
(iii) while on leave for a period of more than seven consecutive days;
(
b ) pays for the retention of his lodgings for the period of that absence; and(
c ) was, immediately prior to that absence, receiving separation allowance under regulation 556b and living out away from home allowance under regulation 568, ration allowance under regulation 569, or lodging allowance under regulation 570 of these Regulations,
retention of lodgings allowance is payable to him in respect of the period of that absence, or thirty consecutive days whichever is the less, at the same rate as the payments made by him for the retention of his lodgings or at a rate equivalent to two-thirds of the rate of the allowance he was receiving under regulation 568, 569 or 570 of these Regulations, as the case may be, whichever is the less.
"(4.) Retention of lodgings allowance is not payable to a member in respect of any period for which he is in receipt of living out allowance, living out away from home allowance, ration allowance or lodging allowance.".
"571b. A claim for an increased rate of an allowance payable under this Division, consequent upon the promotion of a member to a higher rank, is not payable for a period prior to the date upon which the promotion is officially notified.
"571c.—(1.) At the time of claiming living out allowance or living out away from home allowance, a member shall furnish to his commanding officer, in accordance with a form approved by the Air Board, such particulars relating to his wife or children and to his place of residence as are indicated in the form to be required.
"(2.) When living out allowance or living out away from home allowance is being paid to a member and a person stated previously to be dependent upon him ceases to be so dependent, or a change occurs in his domestic circumstances or in his matrimonial relationship to his wife which is likely to affect the rate of the allowance or the continuation of the allowance, the member shall forthwith notify his commanding officer in writing of the change in circumstances.
"571d.—(1.) Where married quarters are provided by the Commonwealth for a member, the rental shall be such amount as the Minister directs.
"(2.) The amount of the rental of those married quarters occupied by a member shall be deducted from his pay.
"571e.—(1.) Furniture may be supplied to a member for use in married quarters provided by the Commonwealth at such charge as the Air Board directs.
"(2.) The amount of the charge for the furniture supplied to a member under this regulation shall be deducted from his pay.
"571f.—(1.) Where a member occupies married quarters provided by the Commonwealth which are supplied with electricity purchased or generated by the Department of Air but are not equipped with a meter for measuring the electricity consumed in those quarters, the member shall be charged for the electricity supplied at such rates as the Air Board directs.
"(2.) The amount of the charge under this regulation for electricity supplied shall be deducted from the pay of the member occupying those married quarters.
"(3.) A member from whose pay a deduction for electricity has been made under this regulation may be supplied without charge with household fuel in accordance with the scale of free issues determined by his commanding officer under such conditions as are approved by the Air Board.
"571g,—(1.) Where a member is provided by the Commonwealth with locked garage accommodation, the rental shall be—
(
a ) if the garage is for a motor car—Fourpence per day; and(
b )if the garage is for a motor cycle—such amount (if any), not exceeding Fourpence per day, as the Air Board directs.
"(2.) The amount of the rental under this regulation for garage accommodation provided for a member shall be deducted from his pay.".
(
a ) by omitting the words "One shilling and ninepence" and inserting in their stead the words "Two shillings and sixpence"; and(
b )by omitting the words "or a band boy".

(2.) Notwithstanding the provisions of the Air Force
Regulations as in force during the period which commenced on the second day of
June, 1955, and ended on the day immediately preceding the date on which these
Regulations are notified in the
(
a ) the rates of active pay;(
b ) the rates of consolidated rates of pay;(
c ) the rates of good conduct increments;(
d ) the rates of flying instructional pay;(
e ) the rates of flying pay;(
f ) the rates of flight pay;(
g ) the rates of outfit allowance; and(
h ) the rates of uniform allowance,
payable to members of the Permanent Air Force, and the rates of special allowances payable to medical and dental officers of the Permanent Air Force, during that period shall be such respective rates as the Air Board determines.
(3.) In determining the rates of pay and allowances and other emoluments for the purpose of sub-regulations (1.) and (2.) of this regulation, the Air Board may determine—
(
a ) different rates of pay and allowances for specified portions of the appropriate periods; and(
b ) different rates of pay, allowances and other emoluments for members included in specified classes of members.
(4.) The powers conferred by the preceding provisions of this regulation shall not be exercised so as—
(
a )to affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) existing at the date on which these Regulations are notified in theGazette in a manner prejudicial to that person; or(
b ) to impose a liability on such a person in respect of anything done, or omitted to be done, before that date.
