254 ('Queensf anzr ANNO DUODECIMO ELIZABETHAE SECUNDAE REGINAE No. 40 of 1963 An Act to Amend " The Agricultural Standards Act of 1952 " in certain particulars [ASSENTED TO 18TH DECEMBER, 1963] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Agricultural Standards Act Amendment Act of 1963." (2) Principal Act. " The Agricultural Standards Act of 1952 " is in this Act referred to as the Principal Act. (3) Collective title . The Principal Act and this Act may be collectively cited as " The Agricultural Standards Acts, 1952 to 1963."
Agricultural Standards Act Amendment Act of 1963, No. 40 255 2. Amendments of s. 7. Section seven of the Principal Act is amended by- (a) in the definition " Cleanser " inserting after the words " cleansing purpose relating to agriculture " the symbol and words ", or used or intended for the purpose of cleansing eggs "; (b) omitting the definition " Department " and inserting in its stead the following definition:- " " Department "-The Department of Primary Industries or other Department of this State in which this Act is for the time being administered; "; (c) omitting the definition " Minister " and inserting in its stead the following definition:- Minister "-The Minister for Primary Industries or other Minister of the Crown for the time being charged with the administration of this Act; "; (d) in the definition " Packeted seeds " omitting the words " in small quantities for use in home gardens " and inserting in their stead the words " in quantities of less than one ounce in weight ". 3. Amendments of s. 9 . (1.) Section nine of the Principal Act is amended by- (a) in paragraph (i) of subsection (2) omitting the words " The Agricultural Chemist " and inserting in their stead the words " The Director of the Agricultural Chemical Laboratory Branch "; (b) in subsection (2) omitting the word " five " and inserting in its stead the word " six "; (c) in subsection (2) omitting paragraphs (iii) to (vii) inclusive and inserting in lieu thereof the figures and words- (iii.) An entomologist (plants); (iv.) A parasitologist (veterinary); (v.) A pathologist (plants); (vi.) A botanist; (vii.) A veterinary surgeon; and (viii.) A veterinary surgeon:". (2.) A botanist may be appointed a member of the Board by the Governor in Council on the nomination of the Minister at any time after the passing of this Act but the first such appointee shall hold office only for the remainder of the term still to run as at the date of his appointment of the other members (other than the ex officio members) then in office of the Board. Paragraphs (b) and (c) of subsection (1) of this section and this subsection shall not affect the tenure of office of those other members.
256 Agricultural Standards Act Amendment Act of 1963, No. 40 4. Amendment of s. 71. Section seventy-one of the Principal Act is amended by inserting the following subsection after subsection (5.) thereof:- " (5A.) Person in possession of agricultural requirement, &c., forfeited to pay costs, &c. All costs, charges and expenses incurred in the handling storing or otherwise dealing with- (a) Any agricultural requirement, material, package, label, or advertising matter or portion forfeited pursuant to the proviso to paragraph (a) of subsection (2.) of this section; or (b) Any prohibited material forfeited pursuant to subsection (5.) of this section, shall be charged to the person in possession of the agricultural requirement, material, package, label, or advertising matter or portion or prohibited material, as the case may be, at the time of the seizure thereof, or if the same were then in possession of a carrier then to the consignor thereof, and may be recovered by the Under Secretary or any person authorised by the Under Secretary as a debt by action in any court of competent jurisdiction."
