B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- *1. (1.) This Act may be cited as" The Agricultural sh tt"tl Requirements Oontrol and Oonservation Act of 1939," and an~r 1 e shall come into force on a date to be proclaimed by the co~ ence Governor in Council by Proclamation published in the men. Gazette, which date is herein referred to as the commencement of this Act. (2.) If at any time after the commencement of this Act the Governor in Council is of opinion that it is no longer necessary to continue this Act in operation he may, by Proclamation published in the Gazette, fix a date from and after which this Act shall expire, and in that event this Act shall be deemed to be repealed on and from the date so fixed: Provided that such repeal shall not prejudice the right to recover any penalty for an offence under or to which this Act relates committed before the date so fixed. * Act proclaimed in force on and from 16th November, 1939. This Act shall be read and construed with of Act. *" The Fertilisers Act of 1935 " and with any other Act (whether passed before or after the commencement of this Act) with which the Governor in Council by Proclamation published in the Gazette proclaims that this Act shall be read and construed. Interpreta. tion of Act. 2. (1.) This Act shall be read and construed so as not to exceed the legislative power of the State to the intent that where any enactment hereof would but for this section have been construed as being in excess of that power it shall nevertheless be a valid enactment to the extent to which it is not in excess of that power. (2.) Every provision, including any Proclamation, Order in Council, regulation, or notice under any other Act (including any Act prescribed to be read and construed with this Act), every law, rule or process oflaw, or judgment of any court of competent jurisdiction, every contract or agreement, whether oral or written, and every deed, document, security, or other writing whatsoever shall, so far as necessary to give full operation and effect to this Act, be read and construed subject to this Act. Indemnity. 3. No action, claim, or demand whatsoever for damages shall lie or be made or allowed by or in favour of any person whomsoever against His Majesty or the Minister or any inspector, officer, or person acting in the execution of this Act, or for or in respect of any damage or loss or injury sustained or alleged to be sustained by reason of the making or operation of any Proclamation, Order in Council, or regulation made or purporting to be made hereunder, or by reason of the commencement or operation of this Act, or by reason of anything done or omitted to be done or purporting to be done or omitted to be done under this Act. Meanings of 4. (1.) In this Act, unless the context otherwise terms. indicates or requires, the following terms have the meanings respectively assigned to them, that is to say:- Accumulate. " Agricultural requirement"-Any fertiliser, any Agricul- se~ ds, and any chemical, substance, or other ~ ~ ~~ rement. thmg capable of being used for the purposes of agriculture which is declared by the Governor in Council by Order in Council to be an essential agricultural requirement; "Hoard"-An accumulated amount or quantity Hoard. of any agricultural requirement in excess of the amount or quantity of such agricultural requirement prescribed to be the maximum amount 9r quantity which anyone person or group of persons may accumulate: and derivatives of this term shall have a corresponding meaning; " Inspector"-An inspector appointed under this Inspector. Act: for the purpose of reading and con- struing this Act with any other Act the term includes an inspector appointed under such other Act; "Minister"-The Secretary for Agriculture and Minister. Stock or other Minister of the Crown charged for the time being with the administration of this Act; " Officer in charge"-Any member of the Public Officer in Service appointed as hereinafter prescribed charge. to be an officer in charge, including any such member for the time being discharging the duties as such of an officer in charge: the term also includes the principal officer in charge appointed as hereinafter prescribed; "Owner"-Includes the owner of and also all Owner. persons having any interest in or mortgage, charge, lien, or other encumbrance on or over any agricultural requirement; "Person"-Includes company, partnership, or Person. firm, and any body or association of persons, . corporate or unincorporate; "Place"-Includes any house, shop, warehouse, Place.. factory, building, ship, barge, boat, vehicle, car, aeroplane, station, wharf, shed, or any land or premises whatsoever and wheresoever situated; " Prescribed"-Prescribed by this Act; Prescribed.

" Sell "-Includes barter or exchange, and also includes dealing in, giving, or supplying, or agreeing to sell or offering or exposing for sale, or having in possession for sale, or sending, forwarding, or delivering for sale, or on sale, or causing, suffering, or attempting any such acts or things: and the derivatives of" sell " have a corresponding inclusive meaning; This Act. "This Act"-This Act and all Proclamations, Orders in Council, regulations, and notices made or given or purporting to be made or given hereunder. (2.) In this Act the power to regulate and control shall include and be deemed to include power to prohibit, restrict, or ration. (3.) For the purpose of reading and construing this Act with any other Act, every term to which a meaning is assigned by such other Act shall, unless a meaning is assigned to it by this Act or the context hereof otherwise indicates or requires, have the meaning assigned to it by such other Act. Adminis- tration of Act. 5. (1.) The Minister shall be charged with the administration of this Act. (2.) The Governor in Council may from time to time appoint members of the Public Service to be officers in charge, and may appoint one such appointee to be the principal officer in charge, and such officers in charge shall, subject to the Minister, be charged with the administration of this Act within the petty sessions district or districts for which they are so appointed: Provided that the principal officer in charge shall, subject to the Minister, be charged with the administration of this Act throughout Queensland, and all officers in charge shall be under his authority. (3.) The Minister may appoint another officer of the Public Service to discharge the duties of the officer in charge at any time when he is absent, and the fact that any such other officer so acts shall be conclusive evidence of the absence of the officer in charge.

Each such appointment as aforesaid shall be notified in the Gazette and thereupon shall be judicially noticed and shall not be questioned in any proceedings whatsoever. (5.) The Governor in Council may appoint such inspectors, other officers, and employees as he shall think necessary for the administration of this Act. The principal officer in charge and every other officer in charge shall, by virtue of his appointment as such, be and be deemed to be an inspector appointed under this Act. 6. The costs, charges, and expenses of the ~ ppropria administration of this Act shall be paid out of the tlOn. Consolidated Revenue Fund, which is hereby appropriated accordingly. 7. (1.) For the purpose of conserving, controlling, Regulation and ad J · US t- mg supp1l·es 0 f any agrl.CuItura1 reqU.lrementoafntdheussealoef or of any constituent, material, or ingredient contained agric.ultural in an agricultural requirement, the Governor in Council :; ~~~ ~ may, at any time and from time to time upon the recommendation of the Minister, make an Order in Council with respect to all or any of the following matters, namely:- (a) Regulating and controlling the sale or supplying at anyone time and/or during any period of time of any agricultural requirement or of any constituent, ingredient, or material contained in any agricultural requirement either generally or in respect of any par1iicular phase or phases of agriculture, or in respect of any other purpose or purposes, or in any petty sessions district or part of a petty sessions district, or in respect of any person or class of persons ; (b) Regulating and controlling the use of any agricultural requirement or ofany constituent, ingredient, or material contained in any agricultural requirement, either generally or

No. 12, for any particular purpose or purposes, or in any petty sessions district or part of a petty sessions district, or by any person or classes of persons ; (c) Regulating and controlling the use of any agricultural requirement, or ofany constituent, material, or ingredient for the purposes of the manufacture, mixing, or preparation of any agricultural requirement, and either generally or in respect of any person or class of persons manufacturing, mixing, or preparing the agricultural requirement concerned; (d) Prescribing what constituents, materials, or ingredients shall be contained in any agricul- tural requirement in lieu of or in addition to any other constituent, material, or ingredient regulated or controlled hereunder, and the maximum and/or minimum proportion or percentage to be so contained. (2.) When any agricultural requirement or any constituent, material, or ingredient of any agricultural requirement registered under any other Act is altered by an Order in Council made under this section such agricultural requirement shall forthwith be and be deemed to be no longer registered under such other Act: Provided that an agricultural requirement in respect of which any alteration has been made by an Order in Council hereunder may be the subject-matter of an application for registration as so altered under the Act concerned without payment of any further fees. . (3.) Any person who contravenes or fails to comply with any provision of- (i.) An Order in Council hereunder; or (ii.) Any Act (including any Proclamation, Order in Council, or regulation thereunder) with respect to an agricultural requirement in respect of which any alteration has been made by an Order in Council hereunder, shall be liable to a penalty of not more than two hundred pounds and, in addition, to a penalty of not more than fifty pounds for each and every day during which such offence is continued.
1939. AGRICULTURE. Agricultt( . ra~ Reqttirements Control, Etc., Act. 17493 In the case of any offence mentioned in paragraph (ii.) of this subsection the penalty hereby prescribed shall be in lieu of the applicable penalty prescribed under the other Act concerned. (4.) If any person wilfully commits any offence mentioned in subsection three of this section he shall be liable on conviction upon indictment to a penalty of not more than five hundred pounds, or to imprisonment with hard labour for twelve months, or to both such penalty and imprisonment. Proof that any offender was warned that any act or omission constitutes an offence shall, upon his indictment for subsequently committing or continuing such offence, be sufficient proof that he wilfully offended until the contrary is proved beyond reasonable doubt. (5.) Where any error is found in any Order in Correction Council under this section the Governor in Council may ~ ; roneous by another Order in Council annul or amend the original notice. Order in Council- or any part thereof, and upon the publication in the Gazette of a further Order in Council the original Order in Council shall be modified to the extent set out in the further Order in Council. (6.) The Commissioner of Prices shall have regard to any Order in Council hereunder in determining the price of any agricultural requirement affected thereby. 9. (1.) The Governor in Council may prescribe by Hoa~ ~ g Order in Council the maximum amount or quantity ofprohlblted. any agricultural requirement which anyone person or group of persons may accumulate. (2.) No person or group of persons shall hoard any agricultural requirement. Any person or member of a group of persons who or which hoards any agricultural requirement shall be liable to a penalty of not more than one hundred pounds, and upon conviction the adjudicating court shall order the agricultural requirement concerned to be forfeited to His Majesty and the same shall thereupon become and be forfeited accordingly and may be dealt with as the Minister thinks fit. 10. (1.) No. 12, their control at any time during the period or at the time specified in the notice to make returns to the principal officer in charge at the Department of Agriculture and Stock, Brisbane, of such agricultural requirement within the time specified in the notice. If any person to whom such a notice applies fails to make such a return within the specified time, or makes any such return which is false in a material particular, he shall be liable to a penalty not exceeding one hundred pounds. Returns ~s, (2.) The Minister may, from time to time, by a ::; quantItIes notice published in the Gazette require all or any persons agri~ ultural or class of persons specified in such notice to make ~ ~ ~ ~ ements returns to the principal officer in charge at the Depart- ment ofAgriculture and Stock, Brisbane, of the quantities of any agricultural requirement sold during the period specified in such notice, including particulars of the various crops on which such agricultural requirement was used or intended to be used and of the district or districts in which such agricultural requirement was sold. If any person to whom such a notice applies fails to make such a return within the specified time, or makes any such return which is false in a material particular, he shall be liable to a penalty not exceeding one hundred pounds. (3.) A certificate under the hand of the principal officer in charge stating that he has not received from any person named therein a return prescribed under this section, or that such return made by such person is false in a material particular, shall be sufficient evidence that such person has failed to make such return or, as the case may be, that the return made by such person is false in the material particular stated, unless the contrary is proved beyond reasonable doubt. Such return shall include such particulars with respect to any agricultural requirement concerned as may be specified in the notice and, in any event, shall

Agricultural Requirements Oontrol, Etc., Act. include particulars of all stocks of any agricultural requirement concerned owned by, or in the possession or control of, the person making the return upon the date when he makes same. If any person to whom such a notice applies fails to make such a return within the specified time, or makes such a return which is false in a material particular, he shall be liable to a penalty not exceeding one hundred pounds. A certificate under the hand of the officer in charge to whom any such return is to be made stating that he has not received from any person named therein a return prescribed under this section, or that the return made by any such person is false in a material particular, shall be sufficient evidence that such person has failed to make such return, or that such return made by such person is false in the material particular mentioned, as the case may be, unless the contrary is proved beyond reasonable doubt. 12. (1.) Any officer authorised in that behalf by Power of an officer in charge or any inspector may- inspection. (a) Enter, inspect, and search any place which he has reasonable ground for believing is kept or used for the making, manufacture, sale, storage, delivery, conveyance, or preparation for sale or supply of any agricultural requirement; (b)· Search for and inspect any agricultural requirement which is being conveyed through or on any street or road, or conveyed by water in any vessel or boat, or by railway or tramway, or aeroplane, or other means of transit apparently for trade, sale, or delivery; (c) Enter, inspect, and search any place where he has reasonable ground for believing is kept .any prescribed agricultural requirement which has been purchased, supplied, or in any other way transferred from one place to any other place; (d) Require the owner or person in possession or charge or the apparent owner or person apparently in possession or charge of any agricultural requirement to state the name and address of the person from whom such

No. 12, agricultural requirement was purchased or received, the price charged or paid therefor (if any), the quantities ordered and received, and also to produce for insp~ ction any contract of sale, sale note, invoice, agreement, circular, catalogue, or advertisement relating to such agricultural requirement given by the supplier or seller, and such other information as is considered necessary by the Minister or officer in charge for or with respect to the administration of this Act. (2.) Any person who withholds any such information. or wilfully fails to produce for inspection any contract of sale, sale note, invoice, agreement, circular, catalogue, or advertisement, or who assaults, intimidates, or obstructs any officer in charge, inspector, or other officer in the exercise of his powers or in the discharge of his duties under this Act, or attempts so to do, or who gives, procures, offers, or promises any bribe, recompense, inducement, or reward to or with intent to influence any officer in charge, inspector, or other officer in the exercise of his powers or in the discharge of his duties under this Act or attempts so to do shall be liable to a penalty of not more than one hundred pounds. Offences generally. 13. (1.) Any person who contravenes or fails to comply with any provision of this Act (including any provision of any Proclamation, Order in Council, regula- tion, or notice made or given under this Act) shall be guilty of an offence and liable if no specific penalty is provided to a penalty of not more than one hundred pounds. Printing (2.) Any person who prints or utters, or who ~ lsepermits, attempts to print or utter, any false or forged authority, o. permit, license, or other document or writing prescribed under or for the purposes of this Act shall be guilty of an indictable offence and liable to a penalty of not more than five hundred pounds, or to imprisonment with hard labour for twelve months, or to both such penalty and imprisonment. If any authority, permit, license, or other document or writing is altered in any particular by a person not duly authorised under this Act to make such alteration, then the same shall be deemed to be false, and to have been printed by every person with whose knowledge, connivance, or consent the alteration was made.

For the purposes of this section any method of reproducing words, letters, or figures in a visible form shall be deemed to be printing. (3.) Upon conviction of an offender the adjudicating Forfeiture. court shall if so prescribed and, in any event, may in its discretion order the forfeiture of all or any part of any agricultural requirement with respect to which the offence was committed: Provided that where the adjudicating oourt has such discretionary power of forfeiture it may in lieu of forfeiture add to the penalty imposed a further sum by way of penalty, but such further sum shall not exceed the value, at the time of the offence, of the agricultural requirement concerned. 14. (1.) If the Minister is of opinion that any person Seizure. is contravening or failing to comply with any provision of this Act (including any provision of any Proclamation, Order in Council, regulation, or notice made or given under this Act) he may authorise any officer in charge to apply in a summary way under *"The Justices Acts, 1886 to 1932," to a court of petty sessions constituted by a police magistrate for an order authorising the seizure by such officer in charge or any person authorised by him (herein referred to as an " authorised person") of any agricultural requirement found to be owned by or in the possession or control of the person suspected to be so offending. (2.) Proceedings under subsection one of this section may be instituted before a court of petty sessions constituted by a police magistrate at any place in Queensland, and upon such proceedings the averment by the complainant that any provision of this Act is being contravened or not complied with shall be sufficient evidence of the fact averred until the contrary is proved beyond reasonable doubt. (3.) Proceedings under this section may be instituted in addition to or in lieu of proceedings to recover any prescribed penalty, and it shall not be a defence to any defendant proceeded against under this section to prove that proceedings have not been instituted against him to recover any prescribed penalty. * 50 Vic. Every owner or person in possession or charge of any agricultural requirement authorised under this section to be seized by an officer in charge or authorised person shall, when required by such officer in charge or authorised person, give possession of such agricultural requirement to such officer in charge or authorised person: Moreover, such officer in charge or authorised person shall have such right of ingress, egress, and regress (together with vehicles, plant, and his assistants or employees) to or from any building, structure, or place at all times as may be necessary to enable the agricultural requirement concerned to be tak~ n possession of and removed. Penalty for failure to give possession of agricul- tural re- quirement taken. (5.) Any person who fails to give possession of any agricultural requirement ordered to be seized under this section to the officer in charge or authorised person empowered to seize same when required by him so to do, or who obstructs or attempts to obstruct such officer in charge or authorised person or any of his assistants or employees in the doing or executing of anything authorised by this section to be done or executed shall be guilty of an offence and liable to a penalty of not more than one hundred pounds and, in addition, to a daily penalty of not more than twenty pounds for each and every day during which such offence is continued. (6.) Any agricultural requirement seized under this section may be sold or otherwise disposed of by the Minister as he shall think fit. If the Minister sells same or any part thereof the sale price or any amount thereof not paid on demand by him shall constitute a debt due to His Majesty and be recoverable accordingly in any court of competent jurisdiction. Averment as evidence. 15. In any proceeding under or for the purposes of this Act the averment on behalf of His Majesty in any information, complaint, pleading, summons, or writ that any material was or is an agricultural requirement, or a constituent, ingredient, or material contained in an agricultural requirement, or was or is the agricultural requirement, or a constituent, ingredient, or material contained in an agricultural requirement mentioned in any Proclamation, Order in Council, regulation, or

Agricultural Req1tirements Control, Etc., Act. notice, demand, or authority made under this Act, or that any place is a place in Queensland and is a place within the meaning of this Act, shall be sufficient evidence of the fact averred until the contrary is proved. 16. (1.) In addition to and without in any way Order~ in limiting the powers of the Governor in Council or the CounCIl. Minister under this Act~ the Governor in Council is hereby empowered from time to time by Order in Council. to issue such orders and give such directions and prescribe such measures as will in his judgment safeguard the efficient distribution and use of all or any agricultural requirements and to give full effect to the objects and purposes of this Act. (2.) The power to make an Order in Council under this Act shall include the power to make Orders in Council differing in respect of different agricultural requirements, or different constituents, materials, and/or ingredients of agricultural requirements, different persons or classes of persons, and/or different localities. 1 7 • Nothing in this Act shall prejudice the powers, Operation of authorities, functions, and jurisdiction of the Com-; T~ eeri g missioner of Prices under *" The Profiteering Prevention P; ~ ve~ io~ Acts, 1920 to 1938," and the Commissioner of Prices# ~~ , ~920to may determine the price of any agricultural requirementpres~ rved. and for that purpose shall have and may exercise all of the powers, authorities, functions, and jurisdiction conferred or imposed upon him by such last-mentioned Acts. 18. (1.) The Governor in Council may from time Regulations. to time make regulations providing for all or any purposes, whether general or to meet particular cases, that may be convenient for the administration of this Act or that may be necessary or expedient to carry out the objects and purposes of this Act. Without limiting the generality of the foregoing provisions, the regulations may provide for all or any of the following matters:- (a) Prescribing the forms to be used under this Act, including forms of returns: Provided that an Order in Council may prescribe any form deemed necessary for the purposes thereof. * 10 Geo. v. (b) Prescribing the manner in which the use of any agricultural requirement may be regulated or controlled either generally or in any particular case or locality. (c) Prescribing that any agricultural requirement normally used in the manufacture of compound or mixed agricultural requirements shall be sold or supplied only when included in a compound or mixed agricultural requirement. (d) Prescribing the returns to be made by owners or persons in charge or possession of any agricultural requirement and/or by users or prospective users of agricultural require- ments, the period to be covered by such returns, the person to whom such returns are to be made, and the information to be disclosed therein. (e) Prescribing all things which by this Act are required or permitted to be prescribed or which are necessary or convenient to be prescribed for giving effect to this Act. . (2.) All such regulations may be made on the passing of this Act. (3.) The power to make regulations hereunder shall include the power to make regulations differing in respect of different agricultural requirements, different persons or classes of persons, and/or different localities. Any such Proclamation, Order in Council, regulation, or notice may be repealed or modified by a subsequent Proclamation, Order in Council, regulation, or, as the case may be, notice under this Act. The publication in the Gazette of any such Proclamation, Order in Council, regulation, or notice shall be conclusive evidence of the matters .contained therein and of the power and authority to make or give such Proclamation, Order in Council, regulation, or notice, as the case may be.

All Proclamations, Orders in Council, and regulations shall be laid before Parliament within fourteen days after such publication if Parliament is in session; and if not, then within fourteen days after the commencement of the next session. If Parliament passes a resolution disallowing any such Proclamation, Order in Council, or regulation, of which resolution notice has been given at any time within fourteen sitting days of such House after such Proclamation, Order in Council, or regulation has been laid before it, such Proclamation, Order in Council, or regulation shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime or to the power to make any further or other Proclamation, Order in Council, or regulation. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - 1. This Act may be cited as "The Fruit and Short title. Vegetables Acts Amendment Act of 1939," and shall be read as one with '*"The Fruit and Vegetables Acts, 1927 to 1935," herein referred to as the Principal Act.
