AN ACT to amend the Agricultural Products

Act, 1929-1964.

[Assented to 4th December, 1964.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation

1. (1) This Act may be cited as the Agricultural

Products Act Amendment Act (No. 2), 1964.

(2) In this Act the Agricultural Products Act,

1929-1964, is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Agricultural Products Act, 1929-1964.

2. Section three A of the principal Act is amended.

amended by substituting for paragraph (c) of

subsection (8), the following paragraph

(c)

to make recommendations and submit proposals to the Minister from time to time with respect to the grades and sizes of the varieties of apples the sale of which should be permitted, and the grades and sizes thereof the sale of which should be prohibited, within the State, and to vary those recommendations and proposals from time to time as circumstances may require; and .

3. Section three B of the principal Act is S. 38

amended—

amended.

(a)

by substituting for the words, "prohibit the sale for consumption within the State of apples of any prescribed grade", in lines five, six and seven of subsection (1), the passage, "permit, or as the case may be, prohibit the sale for consumption within the State of apples that are of a prescribed grade or a prescribed size, or of both a prescribed grade and a prescribed size, of any variety or varieties thereof,"; and

(b)

by deleting the words, "of a prescribed grade" in line three of subsection (2).
