Agricultural Industry Development (Polls)

(Amendment) Regulations 2003

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the extra-territorial committees.

2. Authorising provisions

These Regulations are made under sections 58 and
62 of the Agricultural Industry Development

Act 1990.

3. Commencement

These Regulations come into operation on

27 March 2003.

4. Principal Regulations

In these Regulations, the Agricultural Industry the Principal Regulations.

5. Definition of "roll"

In the definition of "roll" in regulation 5 of the
Principal Regulations, after "the Act" insert "or
prepared in accordance with section 58B(2) of the

Act".

6. Notification of poll

For regulation 6(1) of the Principal Regulations

substitute

"(1) As soon as practicable after the Minister

under section 7(1) or 9(4) of the Act directs

that a poll be held of producers, the returning

officer must publish

(a) in a newspaper circulating generally in Victoria; and
(b) if the Victorian Electoral Commission is authorised by the Minister under section 58B(1) of the Act to conduct a poll of producers in a participating jurisdiction, in a newspaper circulating

generally in that jurisdiction

a notice

(c)

setting out the question on which the poll is to be held; and

(d)

fixing the time and date for the close of voting in the poll; and

(e)

stating where and at what times the roll may be inspected; and

(f)

stating whether or not it is compulsory for persons who are on the roll to vote at the poll; and

(g)

specifying any other details or poll which the returning officer considers it appropriate to include.".

7. Method of voting

In regulation 10 of the Principal Regulations, for

"A" substitute "To cast a vote, a".

8. List of persons who failed to vote

In regulation 14 of the Principal Regulations, for
"conclusion of the poll" substitute "conclusion of

a poll in which voting is compulsory".

9. Notice of result of poll

In regulation 16 of the Principal Regulations, for "in a newspaper circulating generally in Victoria"

substitute

"—

(a)

in a newspaper circulating generally in Victoria; and

(b)

if the Victorian Electoral Commission is authorised by the Minister under section 58B(1) of the Act to conduct a poll of producers in a participating jurisdiction, in a newspaper circulating generally in that jurisdiction".
