Agricultural and Veterinary Chemicals (Control of Use) (Provision of Information on Agricultural Spraying) Order 1996

I make the following order under section 37(1) of the Agricultural and Veterinary Chemicals (Control of Use) Act 1995 .17 December 1996

1Short titleThis order may be cited as the Agricultural and Veterinary Chemicals (Control of Use) (Provision of Information on Agricultural Spraying) Order 1996. 2CommencementThis order takes effect on the day proclaimed under section 2 of the Agricultural and Veterinary Chemicals (Control of Use) Act 1995. 3InterpretationThe Acts Interpretation Act 1931 applies to the interpretation of this order as if the order were by-laws. 4Occupier to provide informationThe occupier of any premises must provide the prescribed information to any person who is employed or contracted to carry out agricultural spraying on those premises – (a) of a prescribed agricultural chemical product or class of agricultural chemical product; or (b) in a prescribed manner – before that person carries out the agricultural spraying. 5Sprayer to provide informationA person who is employed or contracted to carry out agricultural spraying on any premises – (a) of a prescribed agricultural chemical product or class of agricultural chemical product; or (b) in a prescribed manner – must provide the prescribed information to the occupier of those premises before carrying out the agricultural spraying. 6Sprayer prohibited from spraying before receiving informationA person who is employed or contracted to carry out agricultural spraying on any premises – (a) of a prescribed agricultural chemical product or class of agricultural chemical product; or (b) in a prescribed manner – must not carry out the agricultural spraying if he or she has not received the prescribed information the occupier of the premises is required to provide under clause 4.
