1Name

This instrument is the Agricultural and Veterinary Chemicals Code Amendment (Cost Recovery) Regulations 2020.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Agricultural and Veterinary Chemicals Code Act 1994.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Agricultural and Veterinary Chemicals Code Regulations 1995

Subregulation 47(2)

Omit “$305”, substitute “$429”.

Subregulation 71A(1)

Repeal the subregulation, substitute:

1. (1)

   For the purposes of section 164 of the Code, the fee payable for an application for the renewal, or further renewal, of the registration of a chemical product that is made in a financial year specified in an item of column 1 of the table is:

   1. (a)

      if the application is for the renewal, or further renewal, of the product for a period of 12 months—the amount specified in column 2 of the item; or

   2. (b)

      if the application is for the renewal, or further renewal, of the product for a period for 5 years—the amount specified in column 3 of the item.

91Notices of intention to supply hormonal growth promotant

The amendment of subregulation 47(2) of these Regulations made by the Agricultural and Veterinary Chemicals Code Amendment (Cost Recovery) Regulations 2020 applies in relation to a notice given on or after 1 July 2020.

92Applications

The amendments of Schedules 6 and 7 to these Regulations made by the Agricultural and Veterinary Chemicals Code Amendment (Cost Recovery) Regulations 2020 apply in relation to applications made on or after 1 July 2020.
