An Act to consolidate the enac tments re la t ing to the val idi ty of agreements made e lsewhere for personal service in N e w South Wales .

WH E R E A S doubts have arisen as to t h e val idi ty in t he Sta te of N e w Sou th W a l e s of agreements for h i r i ng and service made

or en te red in to b y persons elsewhere t h a n in t h e said Sta te , h u t in tended to t a k e effect the re in , and i t is exped ien t to remove the said doubts , and also to simplify t h e proofs respec t ing t h e m a k i n g of such agree­

m e n t s :  Be i t therefore enacted by t h e K i n g ' s Mos t Exce l l en t Majesty,
b y and w i t h t h e advice a n d consent of t h e Legis la t ive Council and
Legis la t ive Assembly of N e w South W a l e s in Pa r l i amen t assembled,

and by t h e au tho r i t y of t h e same, as follows :—

1. This A c t m a y be cited as t h e " A g r e e m e n t s Val ida t ing Act ,

2. The Agreemen t s Val ida t ing Act , t h i r t y -n ine Victor ia n u m b e r
twen ty -n ine , is hereby repealed.
3. E v e r y con t rac t or ag reemen t made in any place beyond New

Sou th Wales , be tween a n y persons for any personal services to be rendered or performed wi th in t he said State , for and du r ing any period not exceed ing two years from t h e arr ival in t h e said Sta te of t h e person by w h o m such services are to be rendered or performed, or for any period not exceeding two years and th ree m o n t h s f rom t h e date of such ag reement , shal l be as valid b ind ing and effectual be tween the par t ies as if t he said cont rac t or a g r e e m e n t h a d been du ly made and en tered in to in t h e said S ta te :

shall be conclusive evidence of such agency.
Provided t h a t such cont rac t or ag reemen t has been m a d e and

subscribed in t h e presence of some officer duly authorised in t h a t behalf by t h e Governor of N e w South Wales , and is a t tes ted by such officer, a n d has thereon his certificate in t he form or to the effect of t he Schedule annexed to th is Act .

S u c h officer shal l in all cases where any such ag reemen t shall be made or entered in to by any person as a g e n t for or on behalf of any o ther person be bound to ascer tain t h a t such person so s igning as such agen t was du ly au thor i sed so to do, and t h e certificate of such officer

4. I t shal l no t be necessary in a n y m a n n e r to prove in evidence

t he s igna ture of t h e said officer to t he said certificate, if i t purpor t s t o

have been given by h i m as such du ly au thor i sed officer.
5. The p roduc t ion of a n ag reemen t so a t tes ted a n d h a v i n g

the reon such certificate as aforesaid in any Cour t w i th in t h e said S ta t e a n d proof to t h e satisfaction of t h e Court t h a t t h e compla inan t or

defendant , as t h e case m a y be, d i spu t ing t h e au then t i c i ty of such
ag reemen t was known , a t any t i m e since the da te of t he same agree­

m e n t , by t he n a m e and des ignat ion appea r ing on t h e face thereof, shall be deemed a n d held to be evidence t h a t he is t h e person ment ioned

there in , and t h a t h e du ly executed t h e same.

6. I t shal l no t be essential to t he val idi ty of any such con t rac t
or ag reement t h a t i t should be e i ther s tamped or sealed, unless a

corporat ion is a con t rac t ing par ty , no twi ths t and ing t h a t all such wr i t t en

i n s t r u m e n t s are requi red by t h e law of t h e land in which such con t rac t
or ag reemen t was m a d e to be s t amped or sealed, or bo th , before t hey
can be p u t in evidence.
7. On the demand of e i ther p a r t y to any such a g r e e m e n t as

aforesaid m a d e ou t of N e w South Wales , t h e o ther p a r t y the re to shal l re -execute the same a t any t ime after his ar r ival in t he Sta te , and if he refuses or neglec ts so to do, h e shal l be l iable to a pena l ty no t exceeding t w e n t y pounds. Such pena l ty shal l be paid to t h e pa r ty l ay ing the complaint , and its infliction or satisfaction shal l n o t be

deemed to a n n u l or o therwise affect t he ag reemen t .

8. A n y s u m m o n s or o ther legal document in respect of a n y compla in t or o ther legal proceedings for t h e b reach of a n y ag reement as aforesaid, or of any of t h e p reced ing provisions of th is Ac t , m a y be served upon ei ther p a r t y personal ly or by del iver ing the same to any person be ing appa ren t ly above t h e age of four teen years resident a t t he last k n o w n place of abode of t h e person n a m e d in such s u m m o n s or

o ther legal document . 9. Whosoever , forges, a l ters , or offers, u t t e r s , disposes of, or
p u t s off, k n o w i n g the same to be forged or al tered, any certificate u n d e r

th i s A c t p u r p o r t i n g to be a certificate given b y a n officer du ly author ised by the Governor to sign certificates unde r th is Act , shal l be liable to pena l servi tude for a t e r m no t exceeding five years a n d n o t less t h a n th ree years or to impr i sonment for any t e r m not exceeding

two years .
