Agents Amendment Act 2001

No 67 of 2001

An Act to amend the Agents Act 1968

[Notified in ACT Gazette No. S66: 10 September 2001]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Agents Amendment Act 2001.

  2. Commencement

    This Act commences on the day it is notified in the Gazette.

  3. Act amended

    This Act amends the Agents Act 1968.

  4. Applications for licences by individuals
    Section 48

    omit everything before subsection (1) (a), substitute

  5. Applications for licences by individuals

  6. An application by an individual for the grant of a licence to carry on business as an agent—

  7. Section 48 (1) (a)

    at the end insert

    ; and

  8. Section 48 (1) (b) to (d)

    at the end insert

    and

  9. Section 48 (1) (e)

    omit

    renumber paragraphs when Act next republished under the Legislation Act 2001

71ZAClaims

  1. A claim for compensation must—

    (a)be in writing; and

    (b)be given to the board within the appropriate period; and

    (c)state the full name and home address of the claimant; and

    (d)contain full particulars of the claim; and

    (e)be accompanied by a statutory declaration to the effect that the particulars contained in the claim are true.

  2. The board must reject a claim that does not, at the time it is given, comply with subsection (1).

  3. The appropriate period is the earlier of—

    (a)1 year after the day the claimant becomes aware of the failure to account to which the claim relates; or

    (b)2 years after the day the failure to account happens.

  4. However, if before the end of the period within which a claim for compensation would, apart from this subsection, be required to be given, a notice about the making of the claim is published under section 71Z, the appropriate period is the period mentioned in the notice.

  5. Divisions—renumbering

    renumber divisions when Act next republished under Legislation Act 2001
