AGENTS (NO. 2)

No. 18 of 1970

An Ordinance to amend the Agents Ordinance 1968,

as amended by the Agents Ordinance 1970.

1.—(1.) This Ordinance may be cited as the Agents Ordinance

(No. 2 ) 1970.*
(2.) The Agents Ordinance 1968,f as amended by the Agents Ordinance 1970,$ is in this Ordinance referred to as the Principal Ordinance.

(3.) Section 1 of the Agents Ordinance 1970 is amended by

omitting sub-section (2 . ) .

(4.) The Principal Ordinance, as amended by this Ordinance,

may be cited as the Agents Ordinance 1968-1970.

2.   Section 5 of the Principal Ordinance is amended—

(a)

by omitting from sub-section (1.) the definition of " com­ pany "; and

(6) by inserting after sub-section (1.) the following sub­

sections:—
" ( 1 A . ) Subject to the next succeeding sub-section, a reference in this Ordinance to a company shall be read as a reference to a body corporate whether formed or incor­ porated in the Territory or outside the Territory.

" ( 1 B . ) A reference in Part V . to a company shall

not be read as including a reference t o—

(a)

a body corporate incorporated within the Com­ monwealth that is a public authority or instru­ mentality or agency of the Crown;

(b) a corporation sole;

(c)

a building society formed in pursuance of sec­ tion 14A of the Co-operative Societies Ordin­ ance 1939-1966 and registered as such a society under that Ordinance;

(d)

a credit society formed in pursuance of section 14D of the Co-operative Societies Ordinance 1939-1966 and registered as such a society under that Ordinance; or

(e) an association, society, institution or body incor­
porated under the Associations Incorporation
Ordinance 1953-1966.

3 . Section 43 of the Principal Ordinance is amended by adding at the end thereof the following sub-section:—

" (2.) In the application of the last preceding sub-section to a company that is a trading society formed in pursuance of section 13 of the Co-operative Societies Ordinance 1939-1966 and registered as such a society under that Ordinance, paragraph (a) of that sub­ section shall be read as if there were substituted for the words ' Memorandum of Association ' the word ' Rules

4. Section 45 of the Principal Ordinance is amended by adding at the end thereof the following sub-section:—

" (2.) In the application of the last preceding sub-section to a company that is a trading society formed in pursuance of section 13 of the Co-operative Societies Ordinance 1939-1966 and registered as such a society under that Ordinance, paragraph (a) of that sub­ section shall be read as if there were substituted for the words ' Memorandum of Association ' the word ' Rules

5 . Section 47 of the Principal Ordinance is amended by adding at the end thereof the following sub-section:—

" (2.) In the application of the last preceding sub-section to a company that is a trading society formed in pursuance of section 13 of the Co-operative Societies Ordinance 1939-1966 and registered as such a society under that Ordinance, paragraph (a) of that sub­ section shall be read as if there were substituted for the words ' Memorandum of Association ' the word ' Rules

6 . Section 96 of the Principal Ordinance is amended by omitting

sub-section (1. ) and inserting in its stead the following sub-section:—
" (1. ) A person who attends for the purpose of giving evidence
before the Board is entitled to receive such fees and travelling expenses
in accordance with the scale in the Second Schedule to the Public Works
Committee Regulations as in force from time to time under the Public
Works Committee Act 1969 as the Chairman or, if the Chairman is
