The Parliament of South Australia enacts as follows:

1—Short title

This Act may be cited as the Aged Citizens Clubs (Subsidies) Act 1963.

2—Interpretation

In this Act—

council means a council within the meaning of the Local Government Act 1934 and includes any public authority which in the opinion of the Minister performs substantially the functions of a council in any portion of the State not being an area within the meaning of the said Act.

3—Power to subsidise aged citizens clubs and centres

(1)Subject to this Act, the Minister may make a payment to any council or to any body, institution or authority recommended by any such council and approved by the Minister, for the purpose of assisting such council, body, institution or authority to purchase land with or without buildings, to construct or enlarge buildings or to purchase furniture or equipment.

(2)A payment shall not be made under this Act unless the Minister is satisfied that any land, buildings, furniture or equipment to be purchased or constructed is or are intended to be used for the purpose of a club or centre for the provision of physical or mental recreation or welfare services mainly for aged citizens.

(3)A payment shall not be made under this Act unless the council concerned also contributes to the cost of such land, buildings, furniture or equipment and the amount of the payment shall not exceed the amount so contributed by the council and any additional amounts contributed to such cost by any other body or person.

(4)The aggregate of all the payments made by the Minister under this Act in respect of any one club or centre shall not exceed ten thousand dollars.

4—Cessation of operation of club or centre

If any body, institution or authority which has received a payment from the Minister pursuant to this Act is wound up or ceases to exist or ceases to operate a club or centre in respect of which any such payment was made, all assets vested in such body, institution or authority and used for the purposes of the club or centre shall after the discharge of all liabilities in respect thereof be transferred to the council which recommended that body, institution or authority under subsection (1) of section 3 of this Act.

5—Power to impose terms and conditions

Any payment made by the Minister under this Act shall be subject to such terms and conditions as the Minister may as he thinks fit impose.

6—Financial provision

Any amounts required for the purposes of this Act shall be paid out of moneys appropriated by Parliament for that purpose.
