1 Name
This instrument is the Aged Care Legislation Amendment (Reducing Home Care Fees) Instrument 2019.
2 Commencement
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This instrument is made under the following:
(a) paragraph 52D‑3(a) of the Aged Care Act 1997;
(b) the Aged Care (Transitional Provisions) Act 1997.
4 Schedules
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
Schedule 1—Amendments
Aged Care (Subsidy, Fees and Payments) Determination 2014
1 After section 107
Insert:
107A Basic daily care fee
The basic daily care fee is the following amount:
(a) if the care recipient’s level of home care is level 1—$9.44;
(b) if the care recipient’s level of home care is level 2—$9.99;
(c) if the care recipient’s level of home care is level 3—$10.27;
(d) if the care recipient’s level of home care is level 4—$10.54.
2 Section 108 (heading)
Repeal the heading, substitute:
108 Basic daily care fee during suspension period

3 Subsection 130(2)
Repeal the subsection, substitute:
(2) If the care recipient’s income does not exceed the amount of the maximum basic rate of pension payable from time to time under Part 2.2 of the Social Security Act to persons classed as “Not a member of a couple”, the fees must, unless subsection (4) applies, be determined so that they do not exceed the following:
(a) if the care recipient’s level of home care is level 1—15.68% of that maximum basic rate of pension;
(b) if the care recipient’s level of home care is level 2—16.58% of that maximum basic rate of pension;
(c) if the care recipient’s level of home care is level 3—17.05% of that maximum basic rate of pension;
(d) if the care recipient’s level of home care is level 4—17.50% of that maximum basic rate of pension.
