The Parliament of Australia enacts:
This Act may be cited as the
Aged Care (Compensation Amendments) Act 1997 .
This Act commences immediately after the commencement of the
Aged Care Act 1997 (other than Division 1 of that Act).
Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
After “care”, insert “or residential care”.
Note: The heading to section 7 is altered by adding at the end “
or residential care ”.
Repeal the paragraph, substitute:
(a) nursing home care or residential care has been provided to the person; and
(aa) nursing home benefit or residential care subsidy has been paid in respect of the nursing home care or residential care; and
After “care”, insert “or residential care”.
After “benefit” (second last occurring), insert “or residential care subsidy”.
Add “or residential care subsidy”.
Repeal the paragraph, substitute:
(b) nursing home care or residential care has been provided to that person in the course of treatment of, or as a result of, the injury; and
(ba) nursing home benefit or residential care subsidy has already been paid in respect of that nursing home care or residential care; and
Note: The heading to section 8 is altered by adding at the end “
or residential care subsidy ”.
Add “or residential care subsidy”.
Add “or residential care subsidy”.
Omit “
nursing home ”.
After “expenses”, insert “or residential care expenses”.
Omit “nursing home”.
Omit “nursing home” (last occurring).
