I, JUSTINE ELLIOT, Minister for Ageing, make this Determination under section 52-1 of the Aged Care Act 1997.

1              Name of Determination

This Determination is the Aged Care (Amount of flexible care subsidy — Innovative Care Service — Congress Community Development and Education Unit Ltd) Determination 2009 (No. 1).

2              Commencement

This Determination commences on the day when the Approved Provider commences providing aged care at Dija Meta Aged and Disabled Hostel and ceases to have effect on 6 July 2010.

3              Revocation

The Determination of amount of flexible care subsidy under section 52-1 for Congress Community Development and Education Unit Ltd made on 6 July 2009 is revoked.

4              Definition

In this Determination:

Approved Provider means Congress Community Development and Education Unit Ltd.

5              Amount of flexible care subsidy

(1) This Determination applies to a care recipient receiving care of a kind specified in section 15.24 of the Flexible Care Subsidy Principles 1997 provided by the Approved Provider in a residential setting at Dija Meta Aged and Disabled Hostel in accordance with the joint initiative between the Department of Health and Ageing and the Approved Provider.

(2)The flexible care subsidy for a day for a care recipient is the amount worked out in accordance with the following formula:

where n is the number of care recipients receiving flexible care provided by the Approved Provider in a residential setting at Dija Meta Aged and Disabled Hostel on the day.
