An Act to amend the Aged Care Act 1997

The Parliament of Australia enacts:

1Short title

This Act may be cited as the Aged Care Amendment (Accreditation Agency) Act 1998.

2Commencement

This Act commences on the day on which it receives the Royal Assent.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Aged Care Act 1997

At the end of subsection 80‑1(2)

Add:

  1. ; (h)

    the fees (if any) that may be charged, on behalf of the Commonwealth, for services the body provides, or a way of determining such fees.

After subsection 80‑1(2)

Insert:

  1. (2A)

    Fees charged for a service that a body provides under the agreement must not be such as to amount to taxation.
