1  Name

This is the Aged Care (Aged Care Pricing Commissioner—Other Functions) Instrument 2015.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under paragraph 95B‑1(2)(e) of the Aged Care Act 1997.

4  Definitions

In this instrument:

Act means the Aged Care Act 1997.

5  Other functions of the Aged Care Pricing Commissioner

For paragraph 95B‑1(2)(e) of the Act, the Aged Care Pricing Commissioner has the following functions:

(a)  to disclose to the Secretary the following information:

(i) the amount of any extra service fee approved by the Aged Care Pricing Commissioner under Division 35 of the Act;

(ii)  the residential care service in respect of which the extra service fee was approved;

(iii)  the accommodation, food and services that are to be provided to a care recipient for the approved extra service fee;

(iv)  the date on which the extra service fee was approved;

(v)  any other information relating to approved extra service fees required by the Secretary to assist the Secretary to perform a function or duty, or exercise a power, under the Act or the Aged Care (Transitional Provisions) Act 1997;

(b)  to disclose to the Secretary the following information if the information is requested by the Secretary:

(i) the amount of any accommodation payment approved by the Aged Care Pricing Commissioner under section 52G‑4 of the Act;

(ii)  the residential care service or flexible care service in respect of which the accommodation payment was approved;

(iii)  the date on which the accommodation payment was approved;

(iv)  any other information relating to approved accommodation payments required by the Secretary to assist the Secretary to perform a function or duty, or exercise a power, under the Act or the Aged Care (Transitional Provisions) Act 1997;

(c)  to disclose to the Aged Care Complaints Commissioner the following information if the information is requested by the Aged Care Complaints Commissioner and the information relates to a complaint made to the Aged Care Complaints Commissioner:

(i) the amount of any extra service fee approved by the Aged Care Pricing Commissioner under Division 35 of the Act;

(ii)  the residential care service in respect of which the extra service fee was approved;

(iii)  the accommodation, food and services that are to be provided to a care recipient for the approved extra service fee;

(iv)  the date on which the extra service fee was approved;

(v) the amount of any accommodation payment approved by the Aged Care Pricing Commissioner under section 52G‑4 of the Act;

(vi)  the residential care service or flexible care service in respect of which the accommodation payment was approved;

(vii)  the date on which the accommodation payment was approved;

(viii)  any other information relating to approved extra service fees or approved accommodation payments required by the Aged Care Complaints Commissioner to perform his or her functions.
