Determination under section 44-16 (3)

I, JUSTINE ELLIOT, Minister for Ageing, acting under section 44-16 (3) of the Aged Care Act 1997 (“the Act”) REVOKE the Determination under section 44-16(3) of the amounts of CONDITIONAL ADJUSTMENT PAYMENT made on 10 February 2005 and DETERMINE that the amounts of CONDITIONAL ADJUSTMENT PAYMENT for a particular day are the amounts worked out in accordance with the method set out below:

1. Calculate the Base Amount for a particular care recipient and a particular day as follows:

The Base Amount is equal to the basic subsidy amount for the day for the care recipient as determined by Subdivision 44-B of the Act

2. Calculate the amount of the CONDITIONAL ADJUSTMENT PAYMENT for a particular care recipient and a particular day as follows:

The amount of the CONDITIONAL ADJUSTMENT PAYMENT is equal to 0.0875 times the Base Amount.

The Determination commences on 1 July 2008.
