Adoption (Consequential Amendments)

An Act to amend certain Acts in consequence of the enactment of the Adoption Act 1993

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Adoption (Consequential Amendments)  Act 1993.

Commencement

2.  (1)  Section 1 and this section commence on the day on which this Act is notified in the Gazette.

(2)  The remaining provisions commence on the day on which the Adoption Act 1993 commences.

Artificial Conception Act 1985—amendment

3. Section 4 of the Artificial Conception Act 1985 is amended by omitting from subsection (3) “sections 9, 33, 42 and 43 of the Adoption of Children Act 1965” and substituting “sections 8, 43, 54 and 55 of the Adoption Act 1993”.

Birth (Equality of Status) Act 1988—amendment

4. Section 4 of the Birth (Equality of Status) Act 1988 is amended by omitting from subsection (2) “sections 9, 33, 42 and 43 of the Adoption of Children Act 1965” and substituting “sections 8, 43, 54 and 55 of the Adoption Act 1993”.

Children’s Services Act 1986—amendment

5. Section 4 of the Children’s Services Act 1986 is amended by omitting from paragraph (a) of the definition of “adopting parent” in subsection (1) “Adoption of Children Act 1965” and substituting “Adoption Act 1993”.

Testamentary Guardianship Act 1984—amendment

6. Section 3 of the Testamentary Guardianship Act 1984 is amended by omitting from subsection (2) “sections 9, 33, 42 and 43 of the Adoption of Children Act 1965” and substituting “sections 8, 43, 54 and 55 of the Adoption Act 1993”.
