Adoption (Consent to Publication) Amendment Act 2013

An Act to amend the Adoption Act 1988.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Adoption (Consent to Publication) Amendment Act 2013.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Adoption Act 1988
3Amendment of section 31 – Publication of names etc of persons involved in proceedings

Section 31(2)—delete subsection (2) and substitute:

  1. (2)

    This section does not apply to the publication of a person's name or other material tending to identify a person if—

    1. (a)

      written consent to the publication has been given by—

      1. (i)

        if the person is an adult—that person; or

      2. (ii)

        if the person is a child and is not under the guardianship of the Chief Executive—each parent or guardian of the child; or

      3. (iii)

        if the person is a child and under the guardianship of the Chief Executive—the Chief Executive; or

    2. (b)

      the publication has been authorised by the Court.
