ADMINISTRATIVE DECISIONS LEGISLATION AMENDMENT

ACT 1997 No 77—PROCLAMATION

(L.S.) GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Administrative Decisions Legislation Amendment Act 1997 do, by this my Proclamation, appoint 6 October 1998 as the day on which the following provisions of that Act commence:

(a)

Schedule 2.1 (except for Schedule 2.1 [3] and so much of Schedule 2.1 [5] as omits sections 97, 98, 100, 101A, 109 and 112 of the Anti-Discrimination Act 1977), Schedule 2.2 and Schedule 2.3,

(b) Schedule 3,
(c) Schedule 4,
(d) Schedule 5.16 and 5.25,
(e) Schedule 6.1, 6.2, 6.3, 6.4 and 6.6.

EXPLANATORY NOTE

The object of this proclamation is to commence the following provisions of the

Administrative Decisions Legislation Amendment Act 1997:

( a )

certain provisions that confer jurisdiction on the Administrative Decisions Tribunal in respect of matters over which the Equal Opportunity Tribunal (which is to be abolished on the same day by the Administrative Decisions Tribunal Act 1997) presently has jurisdiction (Schedule 2, but Schedule 2.1 [ 3 ] and some o f Schedule 2.1 [5] are not commenced).

provisions that confer jurisdiction on the Administrative Decisions Tribunal in respect of matters over which the Boxing Appeals Tribunal, Legal Services Tribunal, Schools Appeals Tribunal and Veterinary Surgeons Disciplinary Tribunal (which are to be abolished on the same day by the Administrarive Decisions Tribunal Act 1997) presently have jurisdiction (Schedules 3 and 4 ) .

provisions that confer jurisdiction on the Tribunal in respect of certain matters under the Freedom of Information Act 1989, Public Health Act 1991 and Ombudsman Act 1974 (Schedules 5.16, 5.25 and 6.4).

provisions that amend the Defamation Act 1974 to create defences against actions for defamation in relation to publications by or in relation to the Administrative Decisions Tribunal (Schedule 6.1),

provisions that amend the Interpretation Act 1987 to ensure that references in NSW legislation to the Administrative Decisions Tribunal are read as references to the Tribunal established by the Administrative Decisions Tribunal Act 1997 (Schedule 6.2).

provisions that amend the Judicial Officers Act 1986 to ensure that the President of the Tribunal is a judicial officer for the purposes of the making of complaints about the President and other matters under that Act (Schedule 6.3).

ensure that full-time members of the Tribunal have their remuneration determined
provisions that amend the Statutory and Other Offices Remuneration Act 1975 to
under that Act (Schedule 6.6).
