(CONSEQUENTIAL PROVISIONS) ACT 1978

An Act to amend certain Acts in consequence o f certain administrative changes, and to provide for related matters.

BE IT EN A C T E D by the Queen, and the Senate and House o f Rep­ resentatives o f the Com m onwealth o f Australia, as follows:

Short title

1. This Act may be cited as the Administrative Changes (Consequen­ tial Provisions) Act 1978.'

3. (1 ) The Acts specified in Schedule 1 are am ended by omitting

a reference to taking action in pursuance o f a power or function includes a reference to taking further action in pursuance o f action previously taken in pursuance o f a power or function.

(a )

before 20 D ecem ber 1977, the Treasurer took any action in pur­ suance o f a power or function exercisable by him under a prescribed provision o f the Audit Act 1901, under a regulation m ade under that Act or under a direction given under section 63 o f that Act;

(b )

on that date the power to take, or the function o f taking, such action under that provision, regulation or direction became exercisable by the Minister for Finance instead o f the Treasurer; and

(c )

the action taken by the Treasurer would, but for that power or function having ceased to be exercisable by him, have had consequences or effects on or after that date,

then, subject to any action taken on or after that date by the Minister for Finance in pursuance o f the relevant power or function, the action taken by the Treasurer before that date shall have, and shall be deem ed to have had, such consequences or effects on and after that date as it would have, or would have had, i f it had been taken by the Minister for Finance.

Any m oneys (other than moneys standing to the credit o f the

Loan Consolidation and Investment Reserve) that were invested by the Treasurer before 20 Decem ber 1977 under section 21A or sub-section

(4 ) Any securities (other than securities taken in the investment o f m oneys standing to the credit o f the Loan Consolidation and Investment R eserve) or deposits that were taken or m ade before 20 Decem ber 1977 by the Treasurer in his corporate nam e under section 62b o f the Audit Act 1901 (including that section as applied by section 21a o f that Act) shall be deem ed to have been taken or m ade by the Minister for Finance in his corporate nam e under section 62 B o f the Audit Act 1901 as in force on the date o f com m encem ent o f this Act.

(5 ) Any securities (other than securities taken in the investment o f m oneys standing to the credit o f the Loan Consolidation and Investment Reserve or Treasury Bills) or deposits that were taken or made on or after 20 D ecem ber 1977 and before the date o f com m encem ent o f this Act by the Minister for Finance under section 62b o f the Audit Act 1901 (including that section as applied by section 21a o f that Act) shall be deem ed to have been taken or m ade by the Minister for Finance in his corporate name under section 62b o f the Audit Act 1901 as in force on that last-m entioned date.
