I, General The Honourable David Hurley AC DSC, Governor of New South Wales, with the advice of the Executive Council, and in pursuance of Part 7 of the Constitution Act 1902, make the following Order.

Senior Executives and Other Matters) Order 2014

Constitution Act 1902

1      Name of Order

This Order is the Administrative Arrangements (Administrative Changes—TAFE
Senior Executives and Other Matters) Order 2014.

2      Commencement

(1) This Order commences on the day on which it is published on the NSW legislation
website, except as provided by subclauses (2) and (3).
(2) Clause 6 is taken to have commenced on 17 October 2014.
(3) Clause 8 is taken to have commenced on 24 February 2014.

3      Definition

In this Order:
document means any Act or statutory or other instrument, or any contract or
agreement.

4      Establishment of TAFE Commission (Senior Executives) Staff Agency

(1) The TAFE Commission (Senior Executives) Staff Agency is established as a Public
Service agency.
(2) The TAFE Commission (Senior Executives) Staff Agency is responsible to the
Minister for Education.

5      Transfer of part of DEC to TAFE Commission (Senior Executives) Staff Agency

(1) The part of the Department of Education and Communities comprising Public Service senior executives who are employed to enable the TAFE Commission to exercise its functions is transferred from that Department to the TAFE Commission (Senior Executives) Staff Agency.
(2) In any document, a reference to the Department of Education and Communities is, if used in relation to the part of that Department referred to in subclause (1), to be construed as a reference to the TAFE Commission (Senior Executives) Staff Agency.

6      Construction of references to Assistant Minister for Tourism and Major Events

In any document, a reference to the Assistant Minister for Tourism and Major Events is to be construed as a reference to the Minister for Regional Tourism.

7 Amendment of Schedule 1 to Government Sector Employment Act 2013 (Public Service agencies)

Part 3 Separate agencies

Insert at the end of the Part:

TAFE Commission (Senior Executives) *Managing Director of the TAFE
Staff Agency Commission

8 Amendment of Administrative Arrangements Order 2014

(1) Clause 9 Transfer of parts of principal Departments under former Act to new Public
Service agencies

Omit “or in legislation by the Minister for the Environment” from clause 9 (2) (a).
Insert instead “, in legislation administered solely by the Minister for the

Environment or in Part 5A of the Forestry Act 2012”.

(2) Clause 9 (2) (b)
Insert “solely” after “administered”.
