I, the Honourable Margaret Beazley AC QC, Governor of New South Wales, with the advice of the Executive Council, and in pursuance of Part 7 of the Constitution Act 1902 and provisions of the Government Sector Employment Act 2013, authorising the making of orders under that Part, make the following Order.

1 Name of Order
This Order is the Administrative Arrangements (Administrative Changes—
Resilience NSW) Order 2020.
2 Commencement
This Order commences on 1 May 2020 and is required to be published on the NSW legislation website.
3 Definition
In this Order—
document means any Act or statutory or other instrument, or any contract or
agreement.
4 Establishment of Resilience NSW
Resilience NSW is established as a Public Service executive agency related to the
Department of Premier and Cabinet.
5 Amendment of Schedule 1 to Government Sector Employment Act 2013 (Public Service agencies)

7 Transfer of certain staff to Resilience NSW
(1) The persons employed in the Office of Emergency Management in the Department
of Communities and Justice are transferred to Resilience NSW.(2) In a document—
(a) a reference to the Office of Emergency Management in the Department of Communities and Justice is to be construed as a reference to Resilience NSW, and (b) a reference to the Department of Communities and Justice is, if used in relation to the Office of Emergency Management in that Department, to be construed as a reference to Resilience NSW, and (c) a reference to the Secretary of the Department of Communities and Justice is, if used in relation to the Office of Emergency Management in that Department, to be construed as a reference to the Head of Resilience NSW.
8 Construction of certain references
(1)
A reference in Part 5 of the Community Welfare Act 1987, and any other provisions of that Act relating to functions under Part 5, to the Secretary of the Department of Family and Community Services (required by previous order to be construed as a reference to the Secretary of the Department of Communities and Justice) is to be construed as a reference to the Head of Resilience NSW.
(2) A reference in the State Emergency and Rescue Management Act 1989 to—
(a) the Secretary of the Department of Justice (required by previous order to be construed as a reference to the Secretary of the Department of Communities and Justice) is to be construed as a reference to the Head of Resilience NSW, and (b) the Department of Justice (required by previous order to be construed as a reference to the Department of Communities and Justice) is to be construed as a reference to Resilience NSW.
