Constitution Act 1902

MARIE BASHIR, Governor I, Professor The Honourable Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of Part 7 of the Constitution Act 1902 and provisions of the Government Sector Employment Act 2013 authorising the making of orders under that Part, make the following Order.

Administrative Arrangements (Administrative Changes—

Ministers and Public Service Agencies) Order 2014

under the

Constitution Act 1902

1      Name of Order

This Order is the Administrative Arrangements (Administrative Changes—Ministers and Public Service Agencies) Order 2014.

2      Commencement

This Order commences on 23 April 2014 and is required to be published on the NSW legislation website.

3      Definitions

In this Order:
document means any Act or statutory or other instrument, or any contract or
agreement.
GSE Act means the Government Sector Employment Act 2013.
reference to a Minister, Public Service agency or Public Service employee includes
a reference that (by or under any Act) is to be construed or treated as a reference to
that Minister, agency or employee.

4      Amendment of Schedule 1 to GSE Act (Public Service agencies)

(1) Part 1 Departments

Omit the following:

Department of Attorney General and Justice

Department of Finance and Services

(2) Part 1
Insert in appropriate order:

Department of Planning and Environment

Department of Police and Justice

(3) Part 2 Executive agencies related to Departments

Omit “Department of Attorney General and Justice” wherever occurring from the matter relating to the Crown Solicitor’s Office, Fire and Rescue NSW, the Office of the NSW Rural Fire Service, the Office of the NSW State Emergency Service and the Ministry for Police and Emergency Services under the heading Related Department.

Insert instead “Department of Police and Justice”.
(4) Part 2

Omit “Department of Premier and Cabinet” wherever occurring from the matter relating to the Office of Environment and Heritage, the Office of Local Government and the UrbanGrowth NSW Development Corporation Staff Agency under the heading Related Department.

Insert instead “Department of Planning and Environment”.
(5) Part 2
Insert in appropriate order:
Office of Finance and Chief Executive of the Office The Treasury
Services
(6) Part 2
Omit the matter relating to Planning and Infrastructure.

5      Change of name of Department of Attorney General and Justice

(1) The name of the Department of Attorney General and Justice is changed to the
Department of Police and Justice.
(2) In any document, a reference to the Department of Attorney and Justice is to be
construed as a reference to the Department of Police and Justice.

6      Change of name of Department of Finance and Services

(1)  The name of the Department of Finance and Services is changed to the Office of
Finance and Services.
(2)  In any document:
(a) a reference to the Department of Finance and Services is to be construed as a reference to the Office of Finance and Services, and
(b) a reference to the Secretary of the Department of Finance and Services is to be construed as a reference to the Chief Executive of the Office of Finance and Services.

7      Change of name of Planning and Infrastructure

(1)  The name of Planning and Infrastructure is changed to the Department of Planning
and Environment.
(2)  In any document:
(a) a reference to Planning and Infrastructure is to be construed as a reference to the Department of Planning and Environment, and
(b) a reference to the Director-General of Planning and Infrastructure is to be construed as a reference to the Secretary of the Department of Planning and Environment.

8      Transfer of Urban Water Directorate from OFS to DTIRIS

The Urban Water Directorate is transferred, on 1 May 2014, from the Office of Finance and Services to the Department of Trade and Investment, Regional Infrastructure and Services.

9      Ministers to whom certain Public Service agencies responsible

Each of the following Public Service agencies is responsible to the Minister or

Ministers specified in relation to that agency:

10      Construction of references to Premier

In any document, a reference to the Premier is, if used in or in relation to legislation administered by the Minister for Infrastructure, to be construed as a reference to the Minister for Infrastructure.

11      Construction of references to Minister for Primary Industries

In any document, a reference to the Minister for Primary Industries is, if used in or in relation to legislation administered jointly by the Minister for Regional Infrastructure and Services, the Minister for Primary Industries and the Minister for Natural Resources, Lands and Water, to be construed as a reference to any of those Ministers.

12      Construction of references to Minister for Finance and Services

In any document, a reference to the Minister for Finance and Services is, if used in or in relation to legislation administered solely by the Minister for Natural Resources, Lands and Water, to be construed as a reference to the Minister for Natural Resources, Lands and Water.

13      Construction of references to Minister for Tourism, Major Events, Hospitality and Racing

In any document, a reference to the Minister for Tourism, Major Events, Hospitality and Racing is to be construed:

(a) if used in or in relation to legislation administered by the Minister for Tourism and Major Events, as a reference to the Minister for Tourism and Major Events, or
(b) in any other case, as a reference to the Minister for Hospitality, Gaming and Racing.

14      Construction of references to Minister for Planning and Infrastructure

In any document, a reference to the Minister for Planning and Infrastructure is to be construed as a reference to the Minister for Planning.

15      Construction of references to Minister for Healthy Lifestyles

In any document, a reference to the Minister for Healthy Lifestyles is to be construed as a reference to he Minister for Health.

16      Construction of references to Minister for Citizenship and Communities

In any document, a reference to the Minister for Citizenship and Communities is, if used in or in relation to legislation administered by the Minister for Veterans Affairs, to be construed as a reference to the Minister for Veterans Affairs.

17      Construction of references to Minister for Roads and Ports

In any document, a reference to the Minister for Roads and Ports is to be construed as a reference to the Minister for Roads and Freight.

18 Repeal of Administrative Arrangements (Interim Ministerial Changes) Order 2014

The Administrative Arrangements (Interim Ministerial Changes) Order 2014 is repealed.

19      Consequential provisions

(1) The office of Secretary of the Department of Finance and Services is abolished. The person holding that office on its abolition continues to be employed (subject to the GSE Act) in the Public Service as a Public Service senior executive, but does not become the Chief Executive of the Office of Finance and Services by the operation of this Order.
(2) The office of Director-General of Planning and Infrastructure is abolished. The person holding that office on its abolition continues to be employed (subject to the GSE Act) in the Public Service as a Public Service senior executive, but does not become the Secretary of the Department of Planning and Environment by the operation of this Order.
