Administrative Appeals Tribunal Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Administrative Appeals Tribunal Act 1975.

1.   Amendment

1.1   The Administrative Appeals Tribunal Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 5A (Arrangement of business)

2.1 Omit “made”, substitute “made or, because of section 60 of the Veterans’ Affairs (1994-95 Budget Measures) Legislation Amendment Act 1994, taken to have been made,”.

2.2 Omit “or section 39 of the Seamen’s War Pensions and Allowances Act 1940 or a matter remitted to the Tribunal by virtue of section 59 of the Repatriation Legislation Amendment Act 1984, under subsection 107VZZH (5) of the Repatriation Act 1920”.

3.   Schedule 3 (Prescribed decisions for the purposes of regulation 19)

3.1   Item 1:

Omit “the Seamen’s War Pensions and Allowances Act 1940,”.

3.2   Item 1:

Omit “or the Veterans’ Entitlements Act 1986”, substitute “, the Veterans’ Entitlements Act 1986 or a decision that is taken, because of section 60 of the Veterans’ Affairs (1994-95 Budget Measures) Legislation Amendment Act 1994, to have been made under the Veterans’ Entitlements Act 1986”.
