Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Administrative Appeals Tribunal Act 1975.

Principal Regulations

1. In these Regulations, Principal Regulations means the Administrative Appeals Tribunal Regulations.

2. Regulation 16 of the Principal Regulations is amended by omitting “the scale in”.

3. Schedule 2 to the Principal Regulations is repealed and the following Schedule substituted:

SCHEDULE 2 Regulation 16

WITNESSES FEES AND ALLOWANCES FOR EXPENSES

1.A person summoned to appear as a witness, because of his or her professional, scientific or other special skill or knowledge, before the Tribunal must be paid:

(a) if the person is remunerated in his or her occupation by wages, salary or fees—an amount equal to the amount of wages, salary or fees not paid to the person because of his or her attendance for that purpose: and

(b) in any other case—an amount of not less than $81, or more than $407, for each day on which he or she so attends.

2. A person summoned to appear as a witness, other than a witness referred to in item 1, before the Tribunal must be paid:

(a) if the person is remunerated in his or her occupation by wages, salary or fees—an amount equal to the amount of wages, salary or fees not paid to the person because of his or her attendance for that purpose: and

(b) in any other case—an amount of not less than $46, or more than $76, for each day on which he or she so attends.

3. A person summoned to appear as a witness before the Tribunal must be paid a reasonable amount for allowances for:

(a) transport between the usual place of residence of the person and the place that he or she attends for that purpose; and

(b) if he or she is required to be absent overnight from his or her usual place of residence—meals and accommodation.

Schedule 3

4. Schedule 3 to the Principal Regulations is amended:

(a) by omitting from item 1 “Compensation (Commonwealth Government Employees) Act 1971”and substituting “Commonwealth Employees Rehabilitation and Compensation Act 1988”;

(b) by inserting after item 3 the following item:

“3a A decision under the Defence Service Homes Act 1918.
