AN ACT to amend section ninety-eight of the Administration Act, 1903-1934, as reprinted pursuant to the provisions of section seventy- seven of the Administration Act (Estate and Succession Duties) Amendment Act, 1934.

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title.

This Act may be cited as the Administration Act Amendment Act, 1939, and shall be read as one with the

Section ninety-eight of the principal Act, being section thirty-nine in the Act No. 28 of 1934, is amended

Provided that this section shall not apply if and when the final balance of the estate of the deceased person, or the aggregate value of the property dis- posed of under settlement or settlements, or the value of the property disposed of under the non- testamentary disposition (as the case may be) in

relation to which the beneficial interests aforesaid pass to such persons exceeds the sum of six thou- sand pounds.

Provided also that notwithstanding the next pre- ceding proviso this section shall apply if and when the person from whom the property passes, whether under a will or a settlement or settlements or a non- testamentary disposition, is at the time of his death a member of the military, air, or naval forces of His Majesty the King, engaged on active service in connection with any war being waged between the Commonwealth of Australia and any other power, and his death is the direct result of such person being engaged on such active service aforesaid.
