Application for approval of the Adfinis Pty Ltd On-site Construction Enterprise Agreement for New South Wales 2022-2025

  1. An application has been made for approval of an enterprise agreement known as the Adfinis Pty Ltd On-site Construction Enterprise Agreement for New South Wales 2022-2025 (the Agreement) pursuant to s.185 of the Fair Work Act 2009 (the Act) by Adfinis Pty Ltd (the Applicant). The agreement is a single enterprise agreement.

  1. The matter was allocated to my Chambers on 22 December 2022 and was determined on the papers.

  1. There is one pre-approval issue which requires comment.  

  1. On 1 December 2022, all employees were sent an email advising them to cast their vote by reply email on 8 December 2022. This means that employees were notified of the time, place and method of vote 6 clear days prior to the commencement of voting, rather than 7 clear days prior to the commencement of voting as required by s.180(3) of the Act.

  1. In respect of the above deficiency, I do not believe it had the effect of disenfranchising any employee who is covered by the proposed Agreement from participation in the bargaining process. There are two employees covered by the Agreement, with both voting to approve. I am satisfied (taking into consideration s.188(2) of the Act and the decision in Huntsman Chemical Company Australia Pty Limited T/A RMAX Rigid Cellular Plastics & Others) that the procedural or technical error is minor and that the employees were not likely to have been disadvantaged, and accordingly, that there has been a genuine agreement.

  1. The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU), being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) of the Act I note that the Agreement covers this organisation.

  1. I am satisfied that each of the requirements of ss.186, 187, and 188 of the Act as are relevant to this application for approval have been met.

  1. The Agreement is approved and, in accordance with s.54 of the Act, will operate from 7 days after the date of approval of the Agreement. The nominal expiry date is 3 January 2026.
