An Act to impose additional Duties of Customs.

BE t h e advice a n d consent of t h e Legislat ive Council and Legis la t ive
i t enac ted by t h e Queen ' s Mos t Exce l l en t Majesty by and w i t h
Assembly of N e w South W a l e s in Pa r l i amen t assembled and by t h e
au thor i ty of t h e same as follows :—

1. The Cus toms A c t of 1865 is hereby repealed.

2.    I n l ieu of t h e Dut i e s of Cus toms now payable on t h e under ­

ment ioned goods t he r e shall be charged t h e I m p o r t Du t i e s following

which shal l be payable on all such goods now in bond—

4. Provided t h a t all goods impor ted for t h e supply of H e r Majes ty ' s service shall be exempt from all dut ies and imposts of every descr ipt ion whatsoever and t h a t no th ing in th i s A c t contained shall be deemed to a l ter or repeal t h e provisions of t he A c t passed in t h e seventh year of H e r Majesty 's r e ign to author ize t h e issue of wine

du ty free to mi l i ta ry officers.

5. I t shall be lawful for t he impor te r of any goods subject to any du ty of Cus toms to warehouse such goods u p o n t h e first

en t ry

thereof u n d e r t he laws in force for t h e warehous ing of goods wi thou t
paymen t of du ty upon such first en t ry .

6. Eve ry person who shall on or before t h e passing of th i s A c t have made or entered in to any contract or ag reement for t h e sale or delivery upon or a t any t ime after t h e twen ty -n in th day of November one thousand e ight h u n d r e d and sixty-five of any ar t ic le whereupon any addi t ional du ty shall be payable unde r t h e provisions of th i s A c t shall be a t l iberty to add to t h e pr ice cont rac ted for so m u c h money as will be equivalent to t h e addi t ional duty which shal l by reason of such provisions have been paid or made payable on such art icles a n d shall be ent i t led by v i r tue of this A c t to be paid t h e same accordingly by t h e purchaser of such art icle and to sue for a n d recover t h e same agains t such purchaser Provided t h a t in every case where t he pr ice cont rac ted for shall be so added to i t shall be a t t h e opt ion of such purchase r by not ice in wr i t ing u n d e r his h a n d to be served

on t h e o ther pa r ty to such cont rac t w i th in fourteen days after t h e
pass ing of th i s A c t to declare t h e cont rac t nu l l and void a n d t h e same

shall be nu l l a n d void accordingly.
7. This A c t shall be deemed to have come in to operat ion in so far as regards t he dut ies imposed by t h e second section thereof on t h e twen ty -n in th day of November one thousand eight h u n d r e d and s ixty- five and in so far as regards t he dut ies imposed by t h e th i rd section thereof on the twenty-first day of December one thousand e ight h u n d r e d

a n d sixty-five.
8. A n d whereas i t was deemed expedient to close t h e Cus tom
H o u s e on t h e said twen ty -n in th day of November as a p re l iminary to

t h e a l te ra t ion of t he said dut ies Be i t enacted t h a t all Officers of Cus toms and all o ther persons concerned in closing t h e Offices of t h e said Customs and in refusing to t ransac t t h e ordinary business thereof shall be and they are hereby indemnified freed and discharged from and aga ins t all act ions suits prosecut ions and penal t ies whatsoever for

or on account of or connected wi th t h e closing of t h e said Customs
or t he refusal t o receive any moneys in p a y m e n t of dut ies on t he said
day on wh ich t h e said Cus tom H o u s e was so closed or t h e refusal to t r ansac t t he ordinary business thereof and n o such ac t ion suit or prosecut ion shall be ins t i tu ted by or agains t any person wha tever for any such closing or refusal as aforesaid.
