HER HONOUR: This matter concerns an appeal by the appellant

in respect of a conviction on the 22nd of January 2009 for a
count of obstruct police and commit public nuisance. The
grounds of the appeal are that the sentence is manifestly
excessive in all the circumstances.

That appeal notice was filed on the 11th of February 2009.
| On the 19th of May 2009 the matter came before his Honour Judge Shanahan and at that time the matter was listed for hearing on today's date. | 20 |
| On the 14th of April 2009 Legal Aid had written to the | |
| Registrar of the District Court advising that Legal Aid was | |
| not appearing for the appellant and notifying that his address | |
| was 35 Elysian Street, Victoria Point. On the 29th of May a | 30 |
| notice was forwarded to the appellant at that address advising | |
| of the hearing date and advising that if he failed to appear | |
| at the hearing the appeal may be struck out in his absence. I | |
| have had his name called three times this morning, he has not | |
| appeared, and in those circumstances I order that the appeal | 40 |
| be struck out. |
