ACTS AMENDMENT (RETAIL

TRADING HOURS) ACT

No. 114 of 1987

AN ACT to amend the Factories and Shops Act 1963, the

Parliamentary Commissioner Act 1971 and the Constitution

Acts Amendment Act 1899.

[Assented to 31 December 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with the

advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

PART I—PRELIMINARY

Short title

1. This Bill may be cited as the Acts Amendment (Retail Trading

Hours) Act 1987.

Commencement

2.    This Act shall come into operation on the day that the Retail

Trading Hours Act 1987 comes into operation.

PART 11—FACTORIES AND SHOPS ACT 1963

Principal Act

3. In this Part the Factories and Shops Act 1963* is referred to as the

principal Act.

Section 5 amended

4.     Section 5 of the principal Act is amended in subsection (1) by

deleting the definition of "the Committee".

Section 57A amended

5.    Section 57A of the principal Act is amended by repealing

subsection (2).

Part IX amended

6.     Part IX of the principal Act is amended by repealing Division I

and Division II and the headings thereto.

Section 94 repealed

7.     Section 94 of the principal Act is repealed.

Section 95 amended

8.     Section 95 of the principal Act is amended

(a)	by repealing subsection (1); and
(b)	in subsection (3), by deleting "the holidays referred to in subsection (1) of this section" and substituting the following-
" each public holiday and half-holiday ".

Schedule V to the Constitution Acts

Amendment Act 1899 amended

12. Schedule V to the Constitution Acts Amendment Act 1899* is

amended in Part 3—

(a) by deleting the following-

(i)  "The Factory Welfare Board constituted under the Factories and Shops Act 1963.";

(ii)  "The Holiday Resorts Advisory Committee constituted under the Factories and Shops Act 1963."; and

(iii)  "The Retail Trade Advisory and Control Committee constituted under the Factories and Shops Act 1963.";

and

(b) by inserting before the item relating to The Rock Lobster Industry Advisory Committee the following-

" The Retail Shops Advisory Committee established under

the Retail Trading Hours Act 1987. ".

Section 98 amended

9. Section 98 of the principal Act is amended in subsection (1) by

deleting ", on the recommendation of the Committee,".

Section 106 amended

10.  Section 106 of the principal Act is amended in subsection (1)—

(a)	by deleting "or the Committee or any member of the Committee"; and
(b)	by deleting "or by the Committee or any member thereof'.

PART III—PARLIAMENTAR Y COMMISSIONER ACT 1971 AND

CONSTITUTION ACTS AMENDMENT ACT 1899

Schedule to Parliamentary Commissioner

Act 1971 amended

11. The Schedule to the Parliamentary Commissioner Act 1971* is amended by deleting "Factory Welfare Board, Holiday Resorts Advisory Committee and Retail Trade Advisory and Control Committee established under the Factories and Shops Act 1963." and inserting after the item relating to the Real Estate and Business Agents Supervisory Board the following-

" Retail Shops Advisory Committee established under the Retail

Trading Hours Act 1987. ".
