ACTS AMENDMENT

(OCCUPATIONAL HEALTH, SAFETY

AND WELFARE) ACT

No. 11 of 1986

AN ACT to amend the Factories and Shops Act 1963, the Construction Safety Act 1972 and the Machinery Safety Act 1974.

[Assented to 25 July 1986.]

BE it enacted by the Queen's Most Excellent Majesty, by and with theadvice and consent of the Legislative Council and the Legislative

Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

This Act may be cited as the Acts Amendment (Occupational

Health, Safety and Welfare) Act 1986.

Commencement

1.

2.    This Act shall come into operation on such day as is fixed by

proclamation.

3. The Acts referred to in the first column of the Schedule are

amended in the manner set out in the second column.

(Section 3)

Short title of Act

Amendment

1. Factories and Shops Act 1963

(1) Section 3 is repealed.

(2) In section 5, after the definition of "child", the following definition is inserted-

" "Commission" means the Occupational Health, Safety and Welfare Commission established under the Occupational Health, Safety and Welfare Act 1984; ".

In Part VI, the heading to Division 1 is deleted and the following heading is substituted-

" Division 1—Regulations relating to

welfare of employees ".

(4)

Sections 44, 45, 46 and 47 are repealed.

(5) In section 61(1), "on the recom-

mendation of the Board" is deleted.

(6)

In section 62(1), "Board" is deleted and

the following is substituted-

" Commission ".

(7)

In section 66(1), "Board" is deleted and

the following is substituted-

" Commission ".

(8) In section 106(1), "Board" is deleted wherever it occurs and in each place the following is substituted-

" Commission ".

2. Construction Safety Act 1972

Sections 19 and 20 are repealed.

3. Machinery Safety Act 1974

In section 9, subsections (3) to (14) are

repealed.
