ACTS AMENDMENT (MEAT

INDUSTRY) ACT

No. 110 of 1987

AN ACT to amend the Abattoirs Act 1909 and the Marketing of

Meat Act 1971.

[Assented to 19 December 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with theadvice and consent of the Legislative Council and the Legislative

Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

PART I—PRELIMINARY

Short title

1. This Act may be cited as the Acts Amendment (Meat Industry) Act

Commencement

2. The provisions of this Act shall come into operation on such day

as is, or days as are respectively, fixed by proclamation.

PART II—ABATTOIRS ACT 1909

Section 15 amended	"
3. Section 15 of the Abattoirs Act 1909* is amended by repealing

subsection (6) and substituting the following subsection

(6) The Commission may engage in trade in

(a)	tallow, meatmeal, blood meal, or any other meat product not intended for human consumption that is or are normally sold as part of the operations of an abattoir; and
(b)	lungs, spleens, glands and other by-products of slaughtering owned by the Commission and intended for human consumption. ".

PART III—MARKETING OF MEAT ACT 1971

Principal Act

4. In this Part the Marketing of Meat Act 1971 * is referred to as the

principal Act.

[*Act No. 61 of 1971 as amended by Act Nos. 55 of 1977, 78 of 1981, 73

of 1983, 98 of 1985 (as amended by No. 4 of 1986) and 107 of 1985.

Heading to Part I inserted

5. Before section 1 of the principal Act the following heading is

inserted-

" PART I—PRELIMINARY ".

Section 4 amended

6. Section 4 of the principal Act is amended in subsection (1) in the definition of "lamb product" by deleting "Corporation;" and substituting the following-

" Corporation, or purchased by the Corporation under section

22A; ".

Section 7 amended

7. Section 7 of the principal Act is amended

(a) in subsection (3) by deleting "(1) (a)" and substituting the following-

" (1) (b) "; and

(b) in subsection (9) by deleting paragraph (a) and substituting the following paragraph-

" (a) having been appointed under subsection (1) (b), he

ceases to be a lamb producer; ".

Section 10 amended

8. Section 10 of the principal Act is amended in subsection (3) by

deleting "section 7 (la) (e)" and substituting the following-

" section 7 (lb) (e) ".

Section 12 amended

9. Section 12 of the principal Act is amended by deleting "Board"

and substituting the following-

" Corporation ".

Section 14 amended

10. Section 14 of the principal Act is amended in subsection (3) by

deleting "Board" and substituting the following-

" Corporation ".

Section 15 amended

11.     Section 15 of the principal Act is amended in subsection (1) by

inserting after paragraph (e) the following paragraph-

" (ea) carry out, or arrange for the carrying out of, with the approval of the Minister, the selling of live lambs outside the State; ".

Section 22A inserted

12.     After section 22 of the principal Act the following section is

inserted

Purchase of lamb by the Corporation

22A. Notwithstanding the scheme provided for in this Part for the acquisition and marketing of lamb the Corporation may purchase lamb at auction or on farms. ".

Section 31 amended

13.     Section 31 of the principal Act is amended in subsection (2) (a)

by deleting "paragraph (a) of subsection (1) of section 7 of this Act"

and substituting the following

section 7 (1) (b) ".
