ACTS AMENDMENT (FINANCIAL

PROVISIONS OF REGULATORY

BODIES) ACT

No. 77 of 1987

AN ACT to amend certain Acts relating to professional and trade regulatory bodies to impose appropriate and consistent accounting, reporting and audit requirements.

[Assented to 26 November 1987]

BE it enacted by the Queen's Most Excellent Majesty, by and with the

advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Acts Amendment (Financial provisions of regulatory bodies) Act 1987.

Commencement

2.     This Act shall come into operation on 1 January 1988.

Amendment of Acts

3.     The Acts referred to in the first column of Schedule 1 are amended

to the extent to which and in the manner in which they are in the second

column of that schedule expressed to be amended.

Savings and transitional

The amendments contained in this Act shall not apply in respect of a financial year of a board or authority that has ended, or has commenced but has not ended, before this Act comes into operation and any Act amended by this Act shall continue to apply in respect of such a financial year as if it had not been amended.

Section 33 is repealed and the following sections

substituted

Accounts

33. (1) The Board shall cause to be kept proper accounts and records of the transactions and affairs of the Board and shall prepare financial statements in accordance with Australian Accounting Standards.

(2) The financial statements shall be prepared on an accrual basis unless the Board determines otherwise.

Audit

34. The accounts and financial statements of the Board shall be audited at least once a year, at the expense of the Board, by an auditor appointed by the Board with the prior approval of the Minister.

Annual report

35. (1) The Board shall on or before 30 June in each year make and submit to the Minister an annual report of its proceedings for the preceding year ending on 31 December

together with a copy of the financial

statements and the auditor's report.

(2) The Minister shall cause a copy of each annual report, financial statements and auditor's report submitted under subsection (1) to be laid before each House of Parliament within 14 sitting days of that House after receipt of the report by the Minister.

Report to annual general meeting

36. The Board shall submit the audited

financial statements referred to in section 34

to the annual general meeting of architects. ".

Builders' Registration Act 1939

Section 23 is repealed and the following sections

substituted

23. (1) The Board shall cause to be kept

proper accounts and records of the

transactions and affairs of the Board and shall

prepare financial statements in accordance

with Australian Accounting Standards.

(2) The financial statements shall be prepared on an accrual basis unless the Board determines otherwise.

Audit

23A. The accounts and financial statements

of the Board shall be audited at least once a

year, at the expense of the Board, by an

auditor appointed by the Board with the prior

approval of the Minister.

Annual report

23B. (1) The Board shall on or before 31 March in each year make and submit to the Minister an annual report of its proceedings for the preceding year ending on 31 December together with a copy of the financial statements and the auditor's report.

(2) The Minister shall cause a copy of each annual report, financial statements and auditor's report submitted under subsection (1) to be laid before each House of Parliament within 14 sitting days of that House after receipt of the report by the Minister. ".

Chiropractors Act 1964

Sections 16A and 16B are repealed and the following

sections substituted

(2) The financial statements shall be

prepared on an accrual basis unless the Board

Licensed Surveyors Act 1909

After section 25 the following sections are inserted

Medical Act 1894

Section 21E is repealed and the following sections

substituted

(2) The financial statements shall be

prepared on an accrual basis unless the Board

determines otherwise.

Nurses Act 1968

In section 16-

(a) in subsection (1c)

(i)  delete "Public Account" in both places where it occurs and substitute in each place "Consolidated Revenue Fund"; and

(ii)

delete "Account" and substitute

"Fund"; and

(b) subsections (3) and (5) are repealed.

After section 16 the following sections are inserted

Sections 26 and 27 are repealed and the following

Annual report

27A. (1) The Board shall on or before 30 June

in each year make and submit to the Minister

Optometrists Act 1940

In section 16, subsections (4), (5), (6) and (7) are

repealed.

After section 16, the following sections are inserted

Physiotherapists Act 1950

After section 7 the following sections are inserted

Veterinary Surgeons Act 1960

In section 16, subsection (3) is repealed and the

following subsection substituted

(3) Where at any time the funds of the Board are insufficient for the proper administration of this Act, the Board may borrow moneys from the Treasurer on such terms and conditions as the Treasurer approves, including such conditions as to repayment and payment of interest as the Treasurer imposes. ".

After section 16 the following sections are inserted in

Part II

16AA. (1) The Board shall cause to be kept

proper accounts and records of the

transactions and affairs of the Board and shall

prepare financial statements in accordance

with Australian Accounting Standards.

(2) The financial statements shall be prepared on an accrual basis unless the Board determines otherwise.
