ACTS AMENDMENT (FINANCIAL

ADMINISTRATION AND AUDIT) ACT

No. 4 of 1986

AN ACT to amend certain Acts in consequence of the enactment of the Financial Administration and Audit Act 1985 and for related and incidental purposes.

[Assented to 27 June 1986.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

PART I—PRELIMINARY

Short title

1. This Act may be cited as the Acts Amendment (Financial Administration and Audit) Act 1986.

Commencement

2.    This Act shall come into operation immediately before the Acts

Amendment (Financial Administration and Audit) Act 1985 comes into

operation.

PART II—AMENDMENT OF ACTS AMENDMENT (FINANCIAL

ADMINISTRATION AND AUDIT) ACT 1985

Schedule 1 amended

3.     Schedule 1 to the Acts Amendment (Financial Administration and

Audit) Act 1985* is amended

(a) by deleting from the first and second columns the items relating to the Distressed Persons Relief Trust Act 1973, the Health

Education Council Act 1958, the State Transport Co-ordination Act 1981, the Taxi-cars (Co-ordination and Control) Act 1963

and the Transport Act 1966;

(b)	in the item relating to the Anzac Day Act 1960, by renumbering the proposed section numbered "15" in the second column as "15. (1)" and adding after that section as so renumbered the
following subsection -

" (2) Notwithstanding the provisions of the

Financial

Administration and Audit Act 1985, the financial year of

the Trust shall end on 31 December. ";

(c) in the item relating to the Grain Marketing Act 1975, by deleting paragraph (1) in the second column and substituting the follow- ing paragraph-

" (1) Sections 35 (1), (2), (3) and (4) and 37 are repealed

and the following section substituted

37. (1) The provisions of the Financial

Administration and Audit Act 1985 regulating the

financial administration, audit and reporting of statu- tory authorities apply to and in respect of the Grain Pool and its operations.

(2) Notwithstanding the provisions of the Financial

Administration and Audit Act 1985, the financial year

of the Grain Pool shall end on 31 October. ". ";

(d) in the item relating to the Local Government Superannuation

Act 1980, by deleting in paragraph (2) in the second column the

proposed subsection (2) of section 16 and by renumbering the

proposed subsection (3) as subsection (2);

(e) in the item relating to the Marketing of Lamb Act 1971-

(i)  by deleting "Lamb" in the first column and substituting the following-

" Meat "; and

(ii)  by deleting "Board" in paragraph (2) in the second column and substituting the following-

" Corporation "; and

(f) in the item relating to the Metropolitan Region Town Planning

Scheme Act 1959, by deleting paragraphs (1), (2) and (3) in the

second column and substituting the following-

" Section 38 (1) (c) is repealed. ".

PART III—AMENDMENT OF OTHER ACTS

Amendment of Acts

4.     The Acts referred to in the first column of Schedule 1 are repealed

or amended to the extent to which and in the manner in which they are in

the second column of that schedule expressed to be repealed or amended.

Savings and transitional

(1) The repeals and amendments contained in this Act shall not apply in respect of a financial year of a department or statutory authority that has ended before this Act comes into operation and any Act repealed or amended by this Act shall continue to apply in respect of such a financial year as if it had not been repealed or amended.

(2) The repeals and amendments contained in this Act shall not apply

in respect of a financial year of a statutory authority that has commenced

but has not ended before Division 9 or 14 of Part II of the Financial

Administration and Audit Act 1985 comes into operation.

(3) The repeal or amendment by this Act of a provision for or relating to the preparation and approval of the estimates of a statutory authority shall not take effect in respect of a financial year of the statutory auth- ority to which section 42 of the Financial Administration and Audit Act 1985 does not apply.

Construction Industry (1) In section 16(3), delete "Public Account" in both places

Fire Brigades (1) After section 19, the following section is inserted

In section 20, subsections (2), (4), (5), (6), (7), (8) and

(9) are repealed.

(3) Section 21 is repealed.

In section 26, delete "20 and 21" and substitute "19A

and 20".
