AN ACT to amend the Community Welfare Act 1972 with respect to certain offices in the Department for Community Welfare and the name of that Department and to amend certain other Acts consequentially.

[Assented to 19 December 1984.]

RE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

PART I-PRELIMINARY.

1. This Act may be cited as the Acts Amendment Short title.

2. This Act shall come into operation on a day to be fixed by proclamation.

11. Section 8 of the principal Act is amended

(a)

by repealing subsections (1) and (2) and substituting the following subsections

(1) Subject to subsection (2), a person shall be appointed under and subject to the Public Service Act 1978 to the office of Assistant Director- General and that person when so appointed is authorized to exercise any power and perform any duty that the Director-General may exercise or is required to perform under this Act, whether the Director-General is absent or not; but the appointment of an Assistant Director-General does not affect the exercise or discharge by the Director-General himself of any power or duty.

(2) The person who is to be appointed the Assistant Director- General shall be chosen from amongst persons who would be eligible for appointment to the office of Director- General. "; and

15.

(1) In respect of the year ending on 30 June 1985, section 11 (1) of the principal Act shall be taken to have been complied with if the Director- General prepares and furnishes to the Minister a report in writing of the operations of the Department during the period from the date of his appointment as Director-General to 30 June 1985.

(2) A delegation made by the Director of the Department for Community Welfare under section 20 of the principal Act and in force immediately before the coming into operation of this Act shall, upon the coming into operation of this Act, be deemed to have been made by the Director-General and shall continue to have effect in all respects and subject to the same terms and conditions as if it were made by the Director-General; and the Director- General may, with the approval of the Minister, vary or revoke any such delegation.
